I am withholding the requested information as it contains wholly personal
information relating to persons other than yourself, the applicant.

Section 40(2) & (3A) of the Freedom of Information (FOI) Act 2000 provides
an absolute exemption where disclosure of information would lead to a
breach of the principles laid down by the Data Protection Act 2018.

I consider the disclosure of the information which you requested would
constitute unfair processing in contravention of the first data protection
principle because those individuals whose personal data has been withheld
would not have had any reasonable expectation that it would be disclosed
in these circumstances.

Therefore, this response acts as a refusal notice under Section 17(1) of
the Freedom of Information Act in accordance with Section 40(2) & (3A) of
the Act.

The information you have requested is in the attached spreadsheet. I am
withholding the post titles and start dates as it contains wholly personal
information relating to persons other than yourself, the applicant.

Dear Bradford City Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Bradford City Council's handling of my FOI request 'Agency Staff Costs'.

The refusal under Section 17(1) of
the Freedom of Information Act in accordance with Section 40(2) & (3A) of the Act is not valid.

Firstly the council openly advertises jobs both internally and externally by job title and this cannot be deemed as personal data.

Secondly many of these posts have values over £100k or equivalent per annum and the council are legally obliged to report these and having checked you have never done so with the exception of Senior Management posts.

Thirdly it is an assumption put forward by the Council that these agency staff have an expectation of privacy and not a fact.

Many of these staff identify themselves in communications with the public as interim.

Even if someone has access to the whole of the council email/telrphone directory it would be impossible to identify anyone and finally given the amounts of taxpayer money involved it is in the interest if council tax payers to have access to this information.
