RESPONSE

 

1) The spend on agency workers from 1st April 2015 – 31st March 2016 was
£6,663,355

 

2) East Sussex County Council has a contract in place with Adecco for the
prevision of Agency Workers which was awarded via the MSTAR2 framework.

 

b. Adecco was the only Managed Service who was awarded a contract for ESCC
via the MSTAR2 framework. 

 

c. The contract with Adecco went live on 15^th November 2015. The contract
is for 4 years from the start of the contract going live.

 

d. There is an optional 2 year extension within the contract terms.

 

e. The Adecco contract within ESCC is managed by Ruth Wilson who can be

f. We consider this information to be commercially sensitive and therefore
exempt from disclosure. The release of the information is likely to harm
the County Council’s and our suppliers commercial interests. This is
because release would lead to an impact on our suppliers competitiveness
and weakening of our suppliers position by having competitors undercutting
profit margins and copying their model, especially in the context of other
potential Mstar 2 call-off awards /mini competitions. It could also have a
negative impact on the County Council’s ability to trade fairly and get
best value for money.

 

Our authority to withhold the information that we consider to be
commercially sensitive comes from Section 43(2) FOIA. This exemption
requires us to weigh the public interest in us withholding the information
against the public interest in us releasing it. We are permitted up to 20
working days in which to carry out this public interest test. We will
therefore provide you with our final response to your request by 22 July,
which is the 20 working day deadline.

Thank you for your request for information about the above, which has been
dealt with under the terms of the Freedom of Information Act 2000 (FOIA).
Further to our email of 24 June 2016, we have now completed the public
interest test with regard to your request 7275.

 

We acknowledge that there is a public interest in the disclosure of the
detail in services contracted by a public authority in order to ensure
transparency and accountability in the spending of public money. Also,
that such transparency promotes public understanding, safeguards
democratic processes and helps to ensure good decision-making by public
bodies. This in turn upholds standards of integrity, in ensuring justice
and fair treatment for all, in securing the best use of public resources
and in ensuring fair commercial competition in a mixed economy.

 

However, given that disclosure under the FOI Act is considered to be made
to the public at large and not just to the individual requester, we have
taken into account that the requester’s private interests are not in
themselves the same as the public interest and that what may serve those
private interests does not necessarily serve a wider public interest. We
consider that releasing this sensitive information into the public domain
is not in the wider public interest. The release of the information is
likely to harm the County Council’s and supplier’s commercial interests.
This is because release would lead to an impact on our suppliers
competitiveness and weakening of our suppliers position by having
competitors undercutting profit margins and copying their model,
especially in the context of other potential Mstar 2 call-off awards and
mini competitions. It could also have a negative impact on the County

We consider that releasing this sensitive information regarding the KPI’s
and contract into the public domain is likely to result in prejudice to
the commercial interests of the Council and to those of our supplier. This
is because it has the potential to damage our relationship with our
suppliers and undermine the effectiveness of any future tendering process.
This in turn would be likely to have a negative effect on the Councils
ability to achieve best value. It is clearly in the public interest for
local authorities to achieve the most competitive price for the services
they wish to purchase, in order to minimise the use of public funds. This
is particularly relevant in the current financial climate, where the
County Council is required to secure significant savings and reduce the
burden on the public purse. Therefore, we believe that the public interest
in maintaining the exemption outweighs the public interest in favour of
disclosure. The information that we have assessed as exempt will not be
disclosed.
