Refusal notice issued under Freedom of Information Act Section 43(2)

Further to your Freedom of Information Request of 10 June 2022, we can confirm that we hold the information you requested but are unable to provide in full.

We have assessed the content against the Freedom of Information Act, the General Data Protection Regulations (GDPR) and the Data Protection Act 2018 and have concluded that we are unable to release the information in full under Section 43(2) of the Freedom of Information Act –Prejudice to commercial interests and under Section 40 (2) - Personal Information

Section 43(2) exempts information whose disclosure would, or would be likely to, prejudice the commercial interests of any person (an individual, a company, the public authority itself or any other legal entity). We believe that disclosing this information would be likely to prejudice our commercial interests. We have also concluded that suppliers may not expect this information to be disclosed.

We have applied the public interest test and concluded that in this instance we do not believe it is in the public interest to disclose all the information you requested relating to specific contracts.

Section 40 (2) covers the personal data of third parties and exempts disclosure of information that would breach any of the principles in UK GDPR. Providing a breakdown in agency spend as you request by named agency/department would potentially identify data subjects and so contravene the GDPR data protection principle to safeguard the rights and freedoms of individuals.

We have applied the public interest test and concluded that in this instance we do not believe it is in the public interest to disclose all the information you requested relating to spend by each named agency and department.

We have concluded that it is in the public interest to disclose our total spend on recruitment and can confirm as follows:

The College spent a total of £266,168 on agency recruitment of lecturers/Assessors/Learning Support during the 2021/22 academic year (1 Aug 21 – 31 May 22) and this spend was split across temporary and permanent recruitment as shown below:
