Dear Gareth Clements,

 

Thank you for your request for information made under the Freedom of
Information Act 2000 (“the Act”), which we received on 13th October 2021.
Your request was set out as follows:

 

“I would like to request all footage you have relating the episode of
After Dark filmed in 1991 which starred Oliver Reed. This includes footage
not aired.”

 

Outside the scope of the Act, we can confirm that Channel 4 is a
television publisher/broadcaster. This means that we do not make our own
programmes but commission these from hundreds of independent production
companies each year. After Dark was made for Channel 4 by an independent
production company called Open Media Ltd and it is Open Media who own the
right to licence footage from this programme. You can find out more via

Further, for the avoidance of doubt, Channel 4 would not have received any
un-transmitted footage. As the broadcaster, we would only have received
the final edited programme. 

 

For future reference, we can confirm that the Act does not apply to
Channel 4 in the same way as other public authorities because Channel 4 is
not required to make information available which is held for purposes of
journalism, art or literature. This is known as the journalistic
“designation” and is set out in Schedule I, Part VI of the Act. We have
therefore handled your request outside the scope of the Act. 

 

Channel 4 does not offer internal reviews for requests handled outside the
scope of the Act. However, you can apply directly to the Information
Commissioner for a decision. The Information Commissioner can be contacted
