Affordable Housing for 777 the Ridge - Application HS/FA/20/00970 and Appeal

The request was partially successful.

Dear Hastings Borough Council,

The original developer's viability report from December 2020 for application HS/FA/20/00970 stated that the development of 67 units could not support any affordable housing or infrastructure contributions under S106.

This was challenged by HBC Housing during consultation who requested that 26 affordable housing units were provided.

The Officer report to committee confirmed that the application would have 26 affordable housing units and infrastructure contributions. The report refers to an independent RICS valuer's assesment report which led to the developer providing 40% affordable housing (26 uniots and a financial contribution).

No further information was posted against the application from the developer to explain why the developer now considered affordable housing and infrastructure contributions to be acceptable in conflict with their December 2020 viability report.

The application was refused by the planning committee. The developer took the refusal to appeal and won permission for 67 units. The new permission retained infrastructure contributions but reduced the affordable housing contribution from 26 units to zero with HBC consent. There is no information posted against the appeal that explains why HBC changed their position and now considered that the application could not support any affordable housing.

I request the following under FOI:

1. All documents/correspondence between the developer and HBC concerning the change from zero to 26 affordable units following the submission of the Dec 2020 viability report.

2. All documents/correspondence between HBC departments concerning the change from zero to 26 affordable units following the submission of the Dec 2020 viability report.

3. All documents/correspondence between HBC and any other bodies concerning the change from zero to 26 affordable units following the submission of the Dec 2020 viability report.

4. A copy of the independent assesment of the viability report referred to in the officer's report to committee for HS/FA/20/00970.

5. All documents/correspondence between the developer and HBC concerning the reductions from 26 to zero affordable housing units following the refusal of the application.

6. All documents/correspondence between HBC departments concerning the reduction from 26 to zero affordable housing units following the refusal of the application.

7. All documents/correspondence between HBC and any other bodies concerning the reduction from 26 to zero affordable housing units following the refusal of the application.

This report has not been supplied and is not available online.The assesment supplied is a later report that accepts that no afforable housing can be provided. I require the earlier report that stated that 26 units could be provided. Please provide.

You state that all other information is online. There are no records of emails and correspondence between HBC departments recorded online. I think it unlikely that HBC holds no correspondence/emails as requested by questions 1 to 3 and questions 5 to 7. Please confirm that HBC holds no correspondence / emails as requested by these questions.

I have been asked, as a senior officer of the council who has not been
involved in your case to look into how we handled your request.
 
Hastings Borough Council received the following request on 3 December 2022
 
The original developer's viability report from December 2020 for
application HS/FA/20/00970 stated that the development of 67 units could

S106.

Please accept my apologies, the document dated 14.10.2019 is a section 106 agreement not the viability report as you have indicated.

I have been advised that there would not have been a viability report for HS/OA/17/00645, they were providing affordable homes on that application, and were not claiming the development was unviable in that regard.

The default position of large residential developments is that they provide affordable housing or make a contribution towards providing them, in line with planning policy. They only provide a Viability Report if the applicant wants to make a case that it is not financially viable to make that provision, as was the case for later applications on this site.
