Affordable housing contribution usage

We're waiting for Luke Chafer to read recent responses and update the status.

Dear Freedom of Information team,

I would like to make a request under the freedom of information act.

I would like the following information.

- I would like to know how much money the council has collected in affordable housing contributions under section 106 or community infrastructure levies in the years: 2023,2022,2021,2020.
- I would like to know for the same years how much of the money was spent.
- I would also like a list of the projects that the money was spent on.

Thank you for your information request received today.

 

I am currently reviewing your request and investigating whether there is
any information available for disclosure.  The Council, in accordance with
Section 10 of the Freedom of Information Act 2000 (‘the Act’), will reply
to your request promptly and in any event not later than the twentieth
working day following the date of receipt. Subject Access Requests will be
responded to within one calendar month in line with the GDPR (General Data
Protection Regulation).

 

In accordance with section 8(1)(b) of the Act and related guidance from
the Information Commissioner’s Office, the Council reserves the right to

I refer to your information request dated 16 April 2024 received in our
office on the same day.

 

I would like to make a request under the freedom of information act.

 

I would like the following information.

 

- I would like to know how much money the council has collected in
affordable housing contributions under section 106 or community

I have carefully reviewed your request and investigated whether there is
any information disclosable to you. Unfortunately, Lewes District Council
is not able to give you the information because it considers it is exempt
from disclosure. I have set out the reasons for this decision below.

 

I have carefully reviewed your request and investigated whether there is
any information which can be disclosed to you. Unfortunately, the Council
is not able to provide you with the information you have requested because
it considers it exempt from disclosure. Where an exemption has been
applied I have set out the reasons for its application.

 

The Council considers this request to be exempt under Section 14 (1) of
the Freedom of Information Act 2000 [The Act].  This section states that
the Act “does not oblige a public authority to comply with a request for
information if the request is considered to be vexatious or repetitious”.

 

Guidance from the Information Commissioner’s Office on vexatious and
repetitious requests states: - “Effect will need to be considered as well
as intention”. 

 

Even though it may not have been the explicit intention of the applicant
to cause inconvenience or expense, if a reasonable person would conclude
that the main effect of the request would be disproportionate
inconvenience or expense, then it will be appropriate to treat the request
as being both vexatious and repetitious.”

 

This request is substantially the same as your request (Ref 20650) to
which a reply was sent on 26 January 2024.

 

All applicants have a 'right to review'.  A review should be focused on
the original request and should identify how the council’s response failed
to answer your Information Request.  Reviews must be made in writing (or
e-mail) within 40 working days of receipt of this response and addressed
to the Information Governance Reviews Officer, to the address below.
