Would you please confirm when the person with responsibility for Operational Safety on the line of route was informed of the unacceptable level of safety risk to users on Plumpton Level Crossing and provide evidence that Rail Operators operating over the crossing, the ORR and members of the public were advised of this unacceptable level of risk?

The EIR regs only apply to material covered by Reg 2(1)(a): "the state of the elements of the environment, such as air and atmosphere, water, soil, land, landscape and natural sites including wetlands, coastal and marine areas, biological diversity and its components, including genetically modified organisms, and the interaction among these elements" or affecting or affected by those elements (including cost of dealing with them, and human safety in dealing with them). It will be interesting to see how the level crossing works and this request in particular are covered by them. I suspect that invoking the EIR is a simple delaying tactic.

Actually the EIRs cover all the information listed in regulations 2(1)(a)-(f). It's possible that alterations to a level crossing may come under environmental information (e.g. if the structure is being altered which involves work or it involves work such as digging into the ground). Yes, I summarised (b) to (f) with "...or affecting or affected by those elements (including cost of dealing with them, and human safety in dealing with them)". Perhaps that was too radical a summary. But the comment stands: I will be interested to see how the EIR cover a level crossing and the Operational Safety of its *use,* as opposed to the safety of dealing with the environmental aspects of a level crossing, which were not mentioned in the FOI request.

Regulation 2(1)(f) is about "the state of human health and safety". The request relates to communications concerning "safety risk" at a level crossing, which probably explains why the request is being considered under EIR.
