Dear Mr Read

Thank you for your request for information dated 10/07/2017 concerning
Social Workers and Reviews

This is to inform you that your request has been considered and I can
provide the following response:

The Request:

Please can you provide the following
information under the Freedom of
Information Act:
1. How many reviews/reassessments
were conducted during the period
01/01/16 to present by the
following?
a.         Council employed Social
Workers/Reviewing Officers
b.         Independent Social
Workers/Reviewing Officers (not
employed directly by the local
authority)
c.         Reviews/reassessments
allocated to 3rd part recruitment
agency contractors/contracts

PCC/Agency Total
Council
A. Employees 3846
Agency
B/C. Workers 91
3937
2. Can you confirm how many
Reviews/Reassessments to be
undertaken are older the 12 months
and fall outside of Care Act
Compliance (Council Backlog)?

Section 17 of the Freedom of
Information Act 2000 requires Powys
County Council, when refusing to
provide such information (because
the information is exempt) to
provide you the applicant with a
notice which:

(a)  states that fact;

(b)  specifies the exemption in
question and

(c)  states (if that would not
otherwise be apparent) why the
exemption applies.

In this instance the relevant
exemption is Section 12 of the
Freedom of Information Act.

Section 12 of the Freedom of
Information Act 2000 makes provision
for public authorities to refuse
requests for information where the
cost of dealing with them would
exceed the appropriate limit, as
detailed in the Freedom of
Information (Fees and Appropriate
limit) Regulations 2004.

The limit for public authorities is
set at £450 which amounts to a
maximum of 18 hours of search and
retrieval time charged at £25.00 per
person per hour.

The Regulations set out what may be
taken into account when public
authorities are estimating whether
the appropriate limit has been
exceeded. The costs are limited to
those that an authority reasonably
expects to incur in:

·         determining whether it
holds the information requested

·         locating the information
or documents containing the
information

·         retrieving such
information or documents

·         extracting the information
from the document containing it
(including editing or reformatting
information)

We would note that the Care Act 2014
is English legislation and does not
apply to Councils in Wales.

To answer the query regarding how
many reviews/assessments are older
than 12 Months, Powys County Council
would need to interrogate each of
the 3937 reviews/assessments
mentioned in question 1. It would
take approximately 3 minutes per
file to ascertain if it meets the
criteria of this question. 3937 * 3
= 197 hours.

We are therefore not obliged to
provide a response to this part of
your request, as the time required
for officers to locate, retrieve and
extract the data from information
held would exceed the appropriate
limit.

In accordance with Section 12 of the
Freedom of Information Act 2000 I am
unable to provide you with the
details you have requested.
