Cranfield University has reviewed this request and can confirm that we do
hold information.

 

After careful consideration and having consulted with colleagues in the
relevant areas, specifically Cranfield School of Management and
International Partnerships and Student Recruitment, the University is
issuing a refusal notice under Section 43(2) – Commercial Interests of
FOIA.

 

The University considers that the information about applicants, offers and
acceptances and the GMAT scores is exempt under Section 43 (2) –
Commercial Interests of FOIA. The University operates within a competitive
environment and considers that releasing this information would be likely
to reduce its ability to compete on a level playing field by releasing
market sensitive information and information which might be of potential
usefulness to its competitors.

 

Having considered the arguments for and against release the university
considers that in all the circumstances of the case the public interest in
maintaining the exemption outweighs the public interest in disclosure.

I am writing to request an internal review of Cranfield University's handling of my FOI request 'Admission statistics - MBA (full-time)'.

You have cited the likelihood of prejudice to a third party's commercial interests. As you may be aware, ICO guidance states "When a public authority wants to withhold information on the basis that to disclose the information would or would be likely to prejudice the commercial interests of a third party, it must have evidence that this does in fact represent the concerns of that third party. It is not sufficient for the public authority to speculate on the prejudice which may be caused to the third party by the disclosure."

The University of Cambridge has provided a full report of admissions data. As a reputable business school, Cranfield University has the same obligation to ensure transparency for student applicants and the general public.

Thank you for your request for an internal review dated 10 December 2021.

The review has now been undertaken by Philip Aspinall, Chief Operating Officer.

Having reviewed the request and our response, he has concluded that the scope of the information requested would exempt the request in its entirety under Section 12 – Cost of compliance exceeds the appropriate limit of FOIA. The University estimates that to identify, locate and retrieve the information requested would be likely to take in excess of the 18 hours allowed.

However, in accordance with our Section 16 duty to provide advice and assistance on what may be provided within the 18 hours, he has agreed to release the information for questions 1 and 2 which is attached. Please note that where <5 is shown the University considers that the exact number is exempt under Section 40(2) – personal Information of FOIA. To release this information might allow individuals to be identified and contravene data protection legislation.
