Adjudication Decisions

Response to this request is long overdue. By law, under all circumstances, Traffic Penalty Tribunal should have responded by now (details). You can complain by requesting an internal review.

Dear Traffic Penalty Tribunal,

To assist my University research project please kindly confirm the number of Devon County Council & Cornwall County Council cases the Chief Adjudicator Caroline Sheppard has adjudicated on thus far in 2017 and in each case please provide a copy of the decision.

I do not think there will be that many that any great time or cost will be spent.

This would greatly assist me because time and budget restraints make attending your offices to view the register difficult.

Please note that The Parking Adjudicators (known as the Traffic Penalty Tribunal) appointed under the powers in the Traffic Management Act 2004 are not within the definition of a "public authority" in schedule 1 of the Freedom of Information Act 2000. Consequently, the duties created by that Act do not apply to the Parking Adjudicators.

It may take up to 20 working days from receipt of your email for Traffic Penalty Tribunal to consider your request and to provide a formal response.

If this timescale needs to be extended you will be notified and kept informed.

Thank you for your email of 23 November 2017 requesting information under the Freedom of Information Act 2000.

As mentioned in the earlier acknowledgement, please note that The Parking Adjudicators (known as the Traffic Penalty Tribunal) appointed under the powers in the Traffic Management Act 2004 are not within the definition of a "public authority" in schedule 1 of the Freedom of Information Act 2000. Consequently, the duties created by that Act do not apply to the Parking Adjudicators.

Traffic Penalty Tribunal nonetheless makes publicly available a considerable amount of information in relation to the outcome of appeals.

Dear Stuart Wilson,

The link you provide does not cover the adjudicator nor the time period I was interested in. I must admit that I'm disappointed that my very simple request for information that is open to public scrutiny has not been provided without good reason. The cost would have been minimal. London Tribunals make all their adjudication decisions available free of charge for public scrutiny online via their website. This has been the case for over a decade. Please will you explain why TPT does not do the same in respect of the decisions made by their adjudicators? I believe that failing to do so is contrary to Government guidelines on transparency and e-govt, which is why London Tribunals and before them PATAS and NPAS make them available.

I will look into this further but meanwhile I look forward to your explanation.
