• Could you please provide a copy of the service/product specification given to all bidders for when this contract was last advertised?
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?

• Who is the senior officer (outside of procurement) responsible for this contract?

Thank you for your email date 23 August 2024. I have considered your
request under the Freedom of Information Act 2000 (FOIA).

I have answered your questions as follows:

• What are the contractual performance KPI's for this contract?

There are no formal KPI’s for this contract.

• Suppliers who applied for inclusion on each framework/contract and were
successful & not successful at the PQQ & ITT stages

We do not run PQQ stages.

Details of the successful suppliers are available via [1]Actors and Role

However, I am unable to provide you with the details of the suppliers who
were unsuccessful. I believe that an exemption applies under the FOIA,
because disclosure could adversely affect tendering processes and
commercial relationships with third party suppliers in the future.

Section 43(2) FOIA is an exemption for information that, if disclosed,
would be likely to prejudice the commercial interests of any person,
including the organisation holding it. This exemption is subject to a
public interest test. I believe that the public interest lies in
maintaining the exemption rather than in disclosing the information.

We have two annual extensions.

• Has a decision been made yet on whether the framework(s)/contract(s) are
being either extended or renewed?

There has not been a decision on this, therefore this information is not
held for the purposes of the FOIA.

• Who is the senior officer (outside of procurement) responsible for this
contract?

I am unable to provide you with this information because it would breach
data protection legislation to do so. This is because there is a potential
risk of identifying the relevant staff members based on their job title. 

The relevant exemption is section 40(2), by virtue of section 40(3A)(a)
FOIA which applies where the information is the personal data of a third
party and where releasing the information would breach any of the
principles relating to the processing of personal data listed at Article 5
of the General Data Protection Regulation (GDPR). In this instance
disclosure would breach the first principle, which requires the processing
of information to be lawful, fair and transparent. I do not believe that
any of the legal bases for processing listed at Article 6 of the GDPR are
met and therefore giving you the information would be unlawful.
