From his works diary, please kindly list the relevant entries to reflect the activities of the Prime Minister, Boris Johnson.

Parameters:

On 24th February, 2020 between 22:59 and 23:29 when a list of those who died in DWP-related circumstances was being read out in the House of Commons.

Please include date, time and entry description.

If nothing is listed then please provide the entry nearest to 22:59 on that date.

I am writing to request an internal review of Prime Minister's Office's handling of my FOI request 'Activity of Boris Johnson while DWP deaths were being read out in HoC'.

The response to our Freedom of Information request {Your ref: FOI329654} of: "We do not hold information in relation to your request" failed to apply Section 16

"The purpose of section 16 is to ensure that a public authority communicates with an applicant to find out what information they want and how they can obtain it."

What action we require:
It is perfectly reasonable for the Prime Minister's Office to 'provide advice and assistance' on which department holds the Prime Minister's diary so that the information we asked for may be provided.

What the law says - Section 16

16.—(1) It shall be the duty of a public authority to provide advice and assistance, so far as it would be reasonable to expect the authority to do so, to persons who propose to make, or have made, requests for information to it.

16.—(2) Any public authority which, in relation to the provision of advice or assistance in any case, conforms with the code of practice under section 45 is to be taken to comply with the duty imposed by subsection (1) in relation to that case.

Dear FOI Team Mailbox,

No less than 143 working days ago we asked you to list the relevant entries to reflect the activities of the Prime Minister, Boris Johnson on 24th February, 2020 between 22:59 and 23:29 when a list of those who died in DWP-related circumstances was being read out in the House of Commons.

You responded stating you don't hold the information. We prompted you again to identify the entry nearest to 22:59 on that date. In response you said you don't have the information. We then reminded you of your obligation to provide advice and assistance and tell us who therefore holds the diary entry nearest to 22:59 of the date in question. Eventually you replied saying you didn't know.

Ordinarily persons submitting requests cannot ask "Why don't you hold this information" because if you don't hold it then you simply don't hold it. However, since many people have in the past obtained extracts of that SAME DIARY from the Prime Minister's Office it would be reasonable to conclude the Prime Minister's Office DOES hold the diary of the Prime Minister.

With that being the case if you're unable to provide the diary entry nearest to 22:59 on the date in question - claiming you don't possess the information (and you don't know who does), the only way what you're saying could be true is if no entries were ever made in the Prime Minister's diary (ever) prior to the events in question.

We know that simply cannot be true, so while we wait for Information Commissioner intervention we would
like to take this opportunity to clarify what we are asking for.

We would like you to kindly provide the date and time and a copy of the entry in question made into the Prime Minister's diary prior to 22:59 on 24th February 2020 WHENEVER IT MAY BE. For example if the final entry to be made before 22:59 on 24th February 2020 happened to be 8th January 2020 at 20:20 then THAT'S THE ENTRY WE ARE REQUESTING if you'd be so kind to provide it please.

We require the date, time and entry description. We are only interested in the final entry which is of a professional nature. If there are entries for Boris to see his doctor, we are NOT interested in any of those.

We hope this makes the request absolutely clear.

Dear Prime Minister's Office,

Thanks for your response. We needed to be absolutely clear that you knew what we were talking about. Since you are refusing to co-operate this shall now be passed back to the Information Commissioner under ref IC-40922-Z0H7.

Be advised that the Information Commissioner has already issued a Decision Notice to the Department of Health and Social Care ordering them to release their equivalent of this information by the end of November 2020 or face the possibility of Contempt of Court so they are hardly likely to state the Prime Minister's Office is entitled to say that it does not hold any entry of the Prime Minister's diary. It's ridiculous that you're even attempting to pass that off.
