Dear FOI Requests,

Your reply dated 5th March 2019 indicated that you required an extension of time to respond to my request, but that I should receive that response by April 1st at the latest. I have received no further communication and note that the maximum 40 days has now been exceeded.

I would be grateful for your response without further delay.

Yours sincerely,

Dear Mr Bales

Thank you for your email of 2nd April 2019.

Please accept my apologies for the delay in responding to you. Unfortunately, this request is taking longer than we would have liked to administer.

Dear FOI Requests,
I am disappointed to note that the reply that you indicated would be sent to me last week was not forthcoming. As you are aware, you are now considerably beyond the acceptable maximum time for FOI responses to be completed. I would therefore be grateful for a full response without further delay.

Thankyou
Yours sincerely,

Richard Bales

Dear FOI Requests,

Further to your reply dated 2nd April and my subsequent follow-up prompt of 14th April, I now note from press disclosures that similar requests for information from other interested parties have been satisfied by BEIS. There would appear to be no reason why you should be unable to respond to my request and I would therefore be grateful for a full response without further delay.

I must point out again that such a response is now substantially overdue.

Yours sincerely,

Richard Bales

Dear FOI Requests,

Thankyou for your reply, though I am sure that you will understand that it is a totally inadequate response to my call. I was told you would call back, which you have declined to do. I have had previous promises of prompt action which have not been honoured. At no point have I received any explanation as to why this FOI request may be difficult for BEIS to handle, meaning that you are substantially in breach of both the maximum length of time allowed and the legal protocol for handling delays.
I will refer you to my previous prompt which notes replies given to similar requests by other third parties. I would request one more time that I receive a more credible and substantive response without further delay.

Yours sincerely,

Richard Bales

FOI Requests, Department for Business, Energy and Industrial Strategy

Dear Mr Bales

I am writing regarding your FOI request (FOI2019/01852) about the
activities of the Commissioner for Shale Gas during the period 1^st
October 2018 to 31^st January 2019 and your more recent request
(FOI2019/07694) for the same information for the period 1^st February 2019
to 16^th April 2019.

As you may be aware the Commissioner for Shale Gas resigned on 27 April
2019.  As the sponsor department for the role,  all recorded information
formerly held by the Commissioner has now been passed to the Department
for Business, Energy and Industrial Strategy.  This means we are now in
possession of information covering the combined period of your two
requests. We therefore believe it would be most helpful to you if we
provided one response covering both of your requests.  We are aware that
your initial request is overdue and we aim to provide you with this full
response regarding all the information you have requested by the 20^th
working day deadline of your later request which is the 21^st May.  If it
is possible to provide this sooner we will of course do so.

Please let us know if you have any questions or comments.

Yours sincerely,

Dear FOI Requests,

Your own proposed deadline of May 21st has passed without further contact. I would appreciate the full reply that was promised without further delay, as my original enquiry is still unanswered well beyond your legal obligation. I have kept ICO appraised of the situation, but am sure you will agree that such a route of action ought not to be required for a relatively simple FOI request.
Please respond by return.
Many thanks

Yours sincerely,

Richard Bales
