I’ve been liaising with the business area regarding this request. They have confirmed that for the time period requested, there are 3696 individual actions within action plans that would need to be reviewed and considered for redaction where information is exempt from disclosure (e.g. if it identifies patients or staff).

Attached is a copy of the action plan template to demonstrate to you the type of detail that is held. Even allowing just 1 minute per action works out at over 61 hours reading and redaction time.

For this reason, the Trust are considering refusing your request on the basis of the sheer volume of the data involved. Before we draft a final response, I wanted to give you an opportunity to refine your request to make it more manageable.

To be clear, we can provide the total number of incidents with action plans each year, or we could provide the number of individual actions. But, the time frame and focus would need to be reduced significantly if you would like to see copies of action plans.

Initial Request

 

Your initial request dated 15^th November 2017 stated:

On the 22^nd November 2017, we advised we were considering refusing your
request based on the sheer volume of information your request captured. 
We calculated it would take in excess of 61 hours to service your request,
and so asked if you would consider refining your request to make it more
manageable. 

 

On 6^th December 2017, you refined your request, asking instead for
“serious incident reports after deaths of inpatients”.

 

On the 7^th December 2017, we asked you confirm the time period you
sought, and on the same day you confirmed you were seeking financial years
2010/11 to present. 

 

We responded to your request on Friday 29^th December.  I note the
legislative deadline for this request was 9^th January 2018, and as such
we responded within the 20 working days required by S.10(1) of the Freedom
of Information Act.

 

Internal Review

 

On 11^th January 2018 you sent us the following email:

 

I understand the need to remove names but would like an internal review

The Trust acknowledged receipt of your request for review on 12^th January
2017.    

 

Findings of Internal Review

 

As the internal reviewer, I have taken a fresh approach to the handling of
your request.  Having undertaken my review, I believe we have not fully
complied with S.1(1) of the FOI Act.  As part of your correspondence with
the case worker, you were sent a copy of our action plan template, along
with the following email:

The caseworker sent your request wording to the business area, and they
provided the centrally recorded information that you have been provided
with.  I consider the recorded information provided by the business area
did not meet your requested criteria (i.e. all the information recorded in
the action plan), and so it is my opinion that the Trust has failed to
provide the information requested. 

 

I sincerely apologise for this error.  Your request will be re-opened.
Please be advised, however, as more recorded information is captured by
your request for action plans, the Trust will need to further investigate
the recorded information captured by your request, and as such your
request may still attract exemptions.  In line with S.16, the obligation
to advise and assist, you will shortly be contacted by the team and we
will work with you to ensure you receive the best and most appropriate

Further to the below, it has been recognised that we haven’t necessarily
provided you with all the information you previously requested – i.e. we
retrieved some of the information recorded within the action plan
documentation, but not all of it.

 

As such, now we seek some clarity. 

 

Are you seeking copies of the action plan documents (example attached)?

 

The Trust does not centrally record all the information held in that
action plan.  As such, if you do want copies of the action plans, the
process for the team would be to manually locate the incident reports
relating to deaths of inpatients between calendar years 2010 and 2017. 
They would then need to extract the action plans from the incident
reports.  Given the manual retrieval process, this could take in excess of
18 hours, but we can try if this is what you seek. 

 

If the action plan documentation can be retrieved in less than 18 hours,
the action plans would need redacting to remove any identifiable
information.  These may be more heavily redacted than the actions
previously provided as multiple actions on a single action plan form may
make the patient or staff involved more identifiable (e.g. if one action
referred to diabetes and another action referred to a fall). The actions
may build up the picture of the incident in an identifiable manner.

 

I note in your internal review request you state dates have been removed,
and the information is too vague without dates, but you raise no further
complaint.  I can confirm dates were not retrieved as part of the original
request (and as such were not withheld).  The only dates that were
considered were those that were recorded incidentally as part of the
action.  As an alternative, would it be acceptable to receive a date
alongside the existing actions provided?  If so, which date would you be
interested in?  Please be advised, however, if the date would identify the
staff or patient involved, we would seek to exempt the information.

Good afternoon Melanie

FOI ref: 2018/0162

Following receipt of your request, searches were conducted within Pennine Care NHS Foundation Trust (the Trust) to locate the requested information and I can confirm that the information requested is held by the Trust.

In this current request, you have requested action plans relating to the deaths of inpatients. We clarified you wanted the action plan documents themselves, as in the original disclosure, we had already assessed:

•Incident Grade
•Incident Reference
•The proposed actions
•Who is responsible for those actions

These actions were redacted in line with S.41(1) (the protect the identity of the deceased) and S.40(2) (to protect the identity of staff, family members and any other living individuals).

The difficulty we have in providing you with the action plan documentation is that because we have already released the above information into the public domain, we can’t subsequently remove it.

As such we would need to manually review the documentation (552 A4 pages), mirror the redactions we have already undertaken, and then consider how the disclosure then reads as the information together will become more identifiable.

My primary concern is that the actions were redacted in isolation (i.e. you cannot tell how many actions relate to the same patient). For example, if there is an action about diabetes, followed by an action about our RAID team, followed by an action about a fall, you cannot tell if they’re about one patient, two patients, or three. When presented together in the action plans, they tell more of a story, making those involved more identifiable. This may be exacerbated when the staff responsible are added (e.g. it would advise you a drug worker, a consultant psychiatrist and a diabetes nurse were involved in a particular patient's care – again making the deceased more identifiable).

Furthermore, the “By when” date would be subject to redaction, as again, together with the actions, this further helps identify the patient. I would need to look at the data as a whole to assess if we could provide, for example, the month and year, or just the year. But ultimately, I consider the information is of very little public interest, particularly without “Date Action Completed”.

And regarding that Date Completed, we have retrieved these action plans from the Risk team – our central team who manage incidents. They have provided us with their copies of action plans that have been closed at their steering group. On their version of the action plans, the “Date Completed” field isn’t often completed as actions often have lengthy time spans. As such, there is little recorded information to provide for these fields, thus making the “By When” defunct from a public interest perspective. To retrieve the completed action plans from the various teams, is very likely to take in excess of 18 hours, and so would be refused under S.12.

The remaining columns therefore are:
•How will you know when it [the action] has been done
•How will you know if it [the action] has worked
•Action level
•Action theme

The Action Theme and Action Levels are internal categorisation systems, and add nothing to the detail of what has taken place, offering no further transparency into what went wrong, and as such I consider there would be little public interest in disclosing this information.

This leaves “How will you know when it has been done” which is essentially asking what evidence would there be that the action was completed, and “How will you know if it has worked” which is asking how will we know if the action taken has resolved the issue. Both these categories are very corporate, transactional, and again, offer little detail of public interest as we have already set out what needs to happen, and indicated what went wrong. And again, without the date to confirm whether or not the action was completed, I consider this further detracts from the public interest.

To give you some examples of what we have recorded:

With that in mind, I am satisfied that the actions already disclosed to you provided you with the optimal amount of recorded information we could provide to evidence to you, and the public at large, what has gone wrong, and what needs to be fixed.

If we hadn’t provided the actions, and were working from the action plans alone, the actions would have needed to be more heavily redacted to allow disclosure of the remaining information (e.g. “Who Will Do It?” and “By When?”).

Having already disclosed a significant amount of information regarding the actions, I believe the burden that would be put on the two-person FOI team to redact 552 pages to provide the supplementary detail is therefore not justified. Excluding the redactions of the actions undertaken already, so far 4 hours has been spent retrieving the Action Plans for this request, and an hour has been spent printing. It will take me considerably more than 13 hours (bringing us up to the S.12 18hr threshold) to redact the 552 pages of documentation your request captures, and as explained above, the disclosure itself will ultimately add very little to the actions already disclosed.

Before we issue our final response, I wanted to give you an opportunity to explain why you consider there to be serious purpose and value in the additional information contained in the action plans, bearing in mind the information already disclosed and the redaction that would be required. Do you consider there to be a significant public interest that would countermand the burden?

I believe it is likely you’ve made this request on their behalf. If not, please can you advise if you have any personal interests in this disclosure that may alter our decision.
