I would like to have details of all acquisitive crime committed
against Heavy Goods Vehicles ( <7.5tonnes ) Lorries, Trailers,
Goods Vehicles; on a month by month
basis, so far, during 2014 up to December 2014.

I would like to have details of all acquisitive crime committed against Heavy Goods Vehicles ( <7.5tonnes ) Lorries, Trailers, Goods Vehicles; on a month by month basis, so far, during 2014 up to December 2014.

Crimes to include: Theft Of Motor Vehicle, Theft From Motor Vehicle, Robbery, to include attempts.

As set out by the Freedom of Information Act it will be our aim to respond to your request by 19 January 2015. In some cases, however, we may be unable to achieve this deadline. If this occurs we will advise you of the likely timescale within which the response will be provided.

Some requests may also require transference to another Authority in order to answer the query. Again you will be contacted if this is required.

Thank you for your recent request under the Freedom of Information Act
2000 which was received in this office on the 17^th December 2014.

 

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities.  Unless exemptions apply, the first duty at,
Section 1(1) (a), is to confirm or deny whether the information specified
in a request is held. The second duty at, Section1 (1) (b), is to disclose
information that has been confirmed as being held.

 

Under the provisions of those sections of FOIA, I can confirm that
information you requested is held by Gwent Police for the below question
but we are unable to comply with your request to supply information.

 

The information that you are seeking is in relation to the following:

 

Q. I would like to have details of all acquisitive crime committed against
Heavy Goods Vehicles ( <7.5tonnes ) Lorries, Trailers, Goods Vehicles; on
a month by month basis, so far, during 2014 up to December 2014.

 

Crimes to include: Theft Of Motor Vehicle, Theft From Motor Vehicle,
Robbery, to include attempts.

 

A. The exemption applicable to the information you have requested for this
question can be found at Section 12(1) of the Act and this refusal notice
is issued under Section 17.

 

Section 12(1) “does not oblige a public authority to comply with a request
for information if the authority estimates that the cost of complying with
the request would exceed the appropriate limit.” 

In the case of a police force, the appropriate limit is set at £450, which
is calculated at £25 per hour (i.e. 18 hours). Gwent Police would have to
conduct a manual search of in excess of 3,000 records to find and extract
the information for this question. This would take more than 18 hours of
staff time therefore we are unable to answer this question and the
exemption is engaged.

Please note: Gwent Police cannot filter down to type of vehicle.

We appreciate that you may be disappointed on this occasion that we are
unable to provide the requested information. However under Section 16 of
the Freedom of Information Act 2000, we have a duty to assist you in
relation to refining your request, where we may be able to answer some of
your questions.

Review decision/disclosure

 

Gwent Police has considered your review/refined request above and can
confirm that we are going to uphold our original decision not to release
the information you have requested.

 

Unfortunately, our original response has not changed. We would need to
read through over 3,000 MO comment fields and guess what is a Heavy Goods
vehicle (by weight > 7,500 tonnes). At an approx. rate of 2 minutes per
check, totals 222 hours, which would clearly exceed the 18 hour rule.

 

The offer to “send me all the vehicle crime and I will sift through it” is
appreciated, but not possible due to the potential sensitive and personal
data included within the MO comments fields.

 

We can, however, offer a list of vehicles stolen/recovered during the
whole of 2014. This is attached.

 

The Freedom of Information Act is a public disclosure regime, not a
private regime. Any information disclosed under the Act is thereafter
deemed to be in the public domain, and therefore freely available to the
general public and will be published on the Gwent Police website.
