WITNESS STATEMENTS: EHR act breaches, Procedural Unfairness
On 22/10/19 Customer Services Manager HM courts and tribunal services has provided a response, having asked the District Judge. They’ve confirmed my complaint “RELATES TO CAFCASS AND NOT THE COURT” and that they understand Cafcass have already replied to me.

CAFCASS have replied to me in an email on 16/10/19 to say re the Witness statements Ms Rees gathered and filed with the court but not with parties: please be advised under general data protection regulation you will only be entitled to your own data and not information relating to other people. YOU WILL NEED TO CONTACT THE COURT FOR SIGHT OF THE “WITNESS STATEMENTS”

1.:So here we have the same problem; still going round in circles since January 2019. CAFCASS saying contact the court. The Court say it is a matter for CAFCASS who say contact the court, wasting public services by keeping this “Legal Limbo’ going round in circles therefore for accuracy if Ms Rees took it upon herself to gather witness statements and file them with the court is this as HMCTS have now confirmed twice in writing a matter for CAFCASS ?

Dear Children and Family Court Advisory Support Service,

1. Under FPR and direction ‘All’ parties are entitled to be supplied with witness statements therefore why are CAFCASS using GDPR to with hold witness statements , and continue to with hold them under GDPR for 12 months where a party should have had sight of them a year ago in line with family law rules.

2. Is CAFCASS with holding witness statements Family Practice Rules allow all parties copies of under GDPR accurate

3. How after 12 months of CAFCASS with holding witness statements is author authenticity verified

4. CAFCASS are misusing GDPR acting with dishonesty and continuing procedural unfairness to with hold witness statements that Family Law says parties are entitled to. Which is overarching Family Law or GDPR and can CAFCASS reasonably misuse GDPR where Ms Rees has abused her position of power to gather witness statements which was ‘not’ ordered by the court to be within the scope of her enquiries, not determined by family proceedings rules, and ‘not’ directed by the court.

5. Is the Leeds office trialling allowing FCA to undertake FPR in order to relieve the role of judges and what powers have been afforded to CAFCASS to undertake this procedure which may I point out runs contrary to family court procedures.

6. There is further shocking revelations about Ms Walters understanding of the ‘meaning’ of definitions in FPR which, if CAFCASS had dealt with matters could have identified. Ms Walters revelations are matters that MOJ need to address as essentially her revelations strike out the definitions of FPR: witness statements. The impact upon SU’s is too dangerous with information such as the data provided by Ms Walters.
