Dear Greater Glasgow NHS Board,

I am looking for information about how Scottish Courts and/or solicitors approach the NHS for accessing health records:

I would like to have copies of your protocols, guidance and or any other relevant documentation about how you respond to such requests made by the courts or solicitors acting on behalf of the courts or in their own violation?

Do you need to have consent from the patient before releasing information to a court, a solicitor? And what if the patient didn't give consent - what happens?

What is the policy on Dr patient confidentiality?

Is it a crime if an NHS Employee gave a court, or a solicitor personal information without going through the appropriate protocols?

Is it a crime if an NHS Employee gave a court, or a solicitor personal information about a patient without the consent of the individual?

Is it a crime if an NHS Employee gave a court, or a solicitor personal information about a patient when the patient didn't give consent, and that the patient was assessed as having capacity to give consent?

If a patient feels someone from the NHS has released his personal information to a third party, how should he raise this concern with NHS GGC, and what formal action could he take?
