Dear NHS England,

Please can I have details of the procedure a NHS staff member would undertake in order to access my NHS record.

If the individual was not working at my local GP surgery, how would they gain approval in order to access my records?

If they had my NHS number, address and date of birth, would this be enough to access my record from any NHS system in England.

Yours faithfully,

Mr M. Imran.

FOI, England (NHS ENGLAND), NHS England

Dear Mr Imran,

Our reference: Request for Clarification (FOI-053580)

Thank you for your Freedom of Information (FOI) request dated 27 May
2017.

Your exact request was:

“Please can I have details of the procedure a NHS staff member would
undertake in order to access my NHS record.

If the individual was not working at my local GP surgery, how would they
gain approval in order to access my records?

If they had my NHS number, address and date of birth, would this be enough
to access my record from any NHS system in England.”

NHS England may hold information relevant to your request. However, we are
unable to begin processing your request without further clarification.

It may help if we explain that NHS England is not ‘the NHS’. The NHS in
England is not a single organisation but is made up of a range of
organisations such as Hospitals, Clinical Commissioning Groups (CCGs) and
Ambulance Trusts. NHS England is responsible for commissioning primary
care services such as GP and dental surgeries, as well as some specialised
secondary care services. Therefore, any recorded information NHS England
may be able to provide in response to an FOI request will generally relate
to the services NHS England commissions. For information on commissioned
services and the types of information NHS England holds can be found on
our [1]website and [2]publication scheme. For further information on the
NHS, its structure and other NHS organisations please refer to NHS Choices
[3]here.

Under Section 1(3) of the FOI Act, an authority is not obliged to comply
with an FOI request when it reasonably requires further information in
order to identify and locate the information requested. We would be
grateful if you would clarify the following:

·         Are you requesting this information with regard to NHS England
staff?

Please note that NHS Digital is the organisation responsible for managing
SystmOne which is used to supply services for GP practices:

If your request does not relate to NHS England staff and instead relates
to staff from a different organisation (such as hospital staff), you may
wish to redirect your request to the relevant organisation. We have
included the link below to the NHS Choices page which includes contact
details for several NHS organisations:

Please be assured we are keen to assist with your request. However, we
cannot guarantee that Section 12 or any other exemptions under the FOI act
will not apply to any further information requested.

If you still require information from NHS England, please send your
clarified request to [6][NHS England request email] quoting your reference
number as it appears in the subject bar.

Kind regards,

Dear FOI, England (NHS ENGLAND),

Please clarify when you say NHS England staff will that include the staff hospitals and GP surgeries employ? E.g receptionists, nurses etc.

Is systmOne the system used to manage and store personal patient data?

Yours sincerely,

Mr M Imran

Classic stalling techniques being used by the NHS here.

A classic response by an organisation that knows that it's staff will never be best challenged by The Information Commission, The Parliamentary Health Service Commission and/ or PACAC, the Public Administration and Constitutional Affairs Committee

Brace yourself; they will try to wear you down until your query becomes confused beyond recognition. It seems to be their standard practise on here.

FOI, England (NHS ENGLAND), NHS England

Dear Mr Imran,

We are writing further to your email dated 17 July 2017.

It may help if we explain that NHS England does not directly employ
clinical staff such as GP practice staff or nurses.

If your request does not relate to NHS England staff and instead relates
to staff from a different organisation (such as hospital staff), you may
wish to redirect your request to the relevant organisation. We have
included the link below to the NHS Choices page which includes contact
details for several NHS organisations:

·
[1]http://www.nhs.uk/ServiceDirectories/Pag...

SystmOne does store patient data and NHS Digital is responsible for this
system. NHS Digital is a separate organisation to NHS England. As such,
requests regarding SystmOne should be sent directly to NHS Digital:

·         [2]https://digital.nhs.uk/article/253/Freed...

As explained in our original response; any recorded information NHS
England may be able to provide in response to an FOI request will
generally relate to the services NHS England commissions. For information
on commissioned services and the types of information NHS England holds
can be found on our [3]website and [4]publication scheme. For further
information on the NHS, its structure and other NHS organisations please
refer to NHS Choices [5]here.
