Dear Andy Perry,

I am writing in response to your Freedom of Information request in which you asked for copies of tender submissions received by Goldsmiths during a recent procurement exercise.

We consider these submissions to be exempt from disclosure at this stage for the following reasons. On arriving at the following decision, we have relied on the following guidance issued by the Ministry of Justice.

Section 43(2) Commercial interests

The procurement process is currently at the pre-contract signing phase.

In accordance with MOJ guidance, we consider that at this stage it would prejudicial to the commercial interests to both Goldsmiths and the firms who have engaged in the tender process to disclose sensitive material within the tender proposals. We have reviewed the submissions and the remaining non-sensitive information consists of extracts from sales brochures which are already in the public domain.

Section 43(2) is a qualified exemption. This means we must consider the public interest before deciding whether the exemption is engaged. While we recognise that it is in the public interest that procurement is seen to be undertaken in a fair and transparent manner, we consider that this is outweighed by the public interest in Goldsmiths achieving best value for money and commercial suppliers being able to trade fairly.
