Dear Mr Green

Request for Information: Ref NCC-017904-15: Cycle Path Access Barriers

Thank you for your request for information relating to the access barriers
installed on the cycle path adjacent to the new tram line to Clifton.  I
have dealt with your request under the Environmental Information
Regulations 2004.

You asked for:

·        Justification for the installation

·        Evidence used in the decision making process

·        Details and findings of safety audits carried out

·        Consideration and compliance with the Disability Discrimination
Act

·        Details and findings of risk assessments carried out

·        Details of any standards and best practice used to justify the
requirement for barriers at this location

·        Details of who made the decision to install the barriers and who
instructed these works to be carried out

·        Any other reports, investigations and assessments relating to the
installation of the barriers

Nottinghamshire County Council is not responsible for the installation of
the barriers and, therefore, we do not hold any of the information above.
The tram project is run by the City Council and its partners and they will
hold the information you have requested.  However, we do have some
correspondence relating to some of the barriers along a section of the
route and this has been released in response to a previous request and is
available on our Disclosure Log via the following link – I would suggest
that you search for “barriers”

[1]http://www.nottinghamshire.gov.uk/thecou...

One further memo is also attached.  You will  see that some information
has been removed.  This is personal information relating to third parties
and is removed under Regulation 13 of the Environmental Information
Regulations in line with the principles of the Data Protection Act.  I
have re-attached the attachments to the original memo.

We also hold a draft road safety audit which refers to the cycle
barriers.  However, this is not our document and we need to consult with
the City Council to see whether they have any objections to its release.
Draft or unfinished documents may be withheld under Regulation 12 (4) (d)
of the Environmental Information Regulations.  I am waiting for officers
at the City Council to return from annual leave before I can proceed with
this.

However, I expect that you will be submitting your request to the City
Council in which case this document, or the final version if there is one,
will be captured by the scope of your request.  In view of this, I will
not pursue the matter with the City Council unless I hear from you to the
contrary.

The City Council can be contacted at:

You have the right to ask us to review the decision to withhold the
personal information.  If you wish to do so, or if you wish to raise any
concerns about the way your request was dealt with, then please write to
the Team Manager, Complaints and Information, County Hall, West Bridgford,
Nottingham, NG2 7QP or e-mail [email address] quoting the reference
number above.

I hope this is helpful.

The attachments sent to John Cooper by Vinci on 25 February at 9.48 are
the same as those attached to Mike Barnett’s e-mail.

The Staggered Pedestrian Barrier sd1127 is the 6Cs standard detail
referred to in the e-mail from John Cooper dated 25 February at 7.32 and
the Staggered Pedestrian Barriers C03 are the survey results also referred
to in John’s e-mail.

The sketch attached is the missing image from the Vinci e-mail of 31

Dear Wendy.

Thank you for your response to my email and for supplying the missing attachments that I asked for, it is very much appreciated.

Given the content of the email from Karen Nurse, dated 19th May 2015, I am surprised at there being no response to it. Please can you check this again with Karen. Also, in the same email Karen states:
“I was going to raise the issue with the barriers at next weeks IRM meeting however, I wont be able to make it as I will be on leave all week. Rather than wait until the next one could you please raise my concerns.“
It is highly likely that Karen and/or other members of the county council will have received minutes of the meeting. Other representatives of the county council may well have attended that meeting, especially as Karen was unable to attend herself. Therefore, please send me a copy of the minutes of that meeting.

Thank you for your help with matter, I look forward to your response at the earliest possible opportunity.

Regards, Chris Green.
