Dear Cambridgeshire and Peterborough NHS Foundation Trust,

I wrote to you on the 7th December 2023 to request the follow information:

All records held regarding Councillor's, Charities or other third parties attending Governor/NED service visits within the last 12 months.
All records held regarding a service visit to Trafford Ward, North Cambs Hospital on 12th December 2023.

I remind the CPFT that a response with the results of my request should be received no later than 10th January 2024. If I do not receive the results within the next two weeks I will refer my complaint to the ICO without further reference to you.

Yours faithfully,

Anthony Mitchell

Anthony William Mitchell

Dear Cambridgeshire and Peterborough NHS Foundation Trust,

I am now in the position of being being bound by confidentiality until the Information is released under FOI/GDPR and yet needing to make a complaint regarding that exact same issue. As such my email has to be far more vague than I would like.

I am sadly forced to make an FOI for all documents related to the handling, processing, administration, complaint about or the making of my FOI request regarding service visits, due to communications being sent to my Governor's email rather than to this website.

To further complicate matters some correspondence may now also considered my personal information as this was a personal FOI request and not one made by a Governor. As the data subject I give my permission for this information to be released.

Given the circumstances I also raise a complaint over how my personal information was shared by the CPFT and for a response being incorrectly sent to my CPFT email creating this unfortunate issue.

Yours sincerely,

Anthony William Mitchell

Dear CPFT,

Thank you for your response, at this time I request an internal review. I am aware that the information provided is incomplete and that information not related to Section 36 of the Freedom of Information Act was not included.
I also note that any information containing my name or information can be provided as I am the data subject and give permission for you to do so.

Yours sincerely,

Anthony William Mitchell

Dear Mr Mitchell

Thank you for your email.

In order to support your request for an internal review, please could you advise what you believe is missing / incomplete from the original FOI response.

We have noted that in a previous email you have asked to raise a complaint into how your personal information was shared by CPFT and a response incorrectly sent to your CPFT email.

We are happy to review this as part of our internal review response, if you are satisfied with this approach.

Kind Regards,

Natasha Wharton

Dear CPFT,

In order to discuss what is missing I would need to breach the decision made by the CPFT. While I am capable of providing that information directly to the ICO if it becomes necessary, disclosing any of the content in a public forum would not be advisable.

While this is a personal request and should remain as such, I would suggest that you contact me internally in my capacity as a CPFT Governor to request a copy of the records held within my CPFT email. It is possible that these were not collected as part of your original search.

The complaints should remain separate as a complaint made under GDPR, is not the same as an internal review under FOI which is separate legalisation. As you may have gathered, I have a passing familiarity with this subject.

Yours sincerely,

Anthony William Mitchell

Dear Mr Mitchell

Thank you for your email.

We are sorry you are dissatisfied with the handling of your FOI request [FOI F24-483].

We understand that you have requested the following information from us, based on concerns you have raised within the below email and previous emails we have received from you.

Internal Review

You have requested an internal review to be carried out as you are concerned that some information you have asked for is missing from our response.

We can confirm that this request has been logged and will be responded to within 20 working days.

Complaint

You also wish to raise a complaint regarding how your personal data was used / shared by CPFT and this will be logged as a new complaint via our Complaints Service.

However, please be aware that What do they Know is a public forum, and as such, we would encourage you to provide us with another email address for communication, in order to ensure the safety and security of your own personal data.

FOI Request

You wish to make a further FOI request for the following information: ‘all documents related to the handling, processing, administration, complaint about or the making of my FOI request regarding service visits’.

We can confirm that this has been logged as a new FOI request and will be responded to within 20 working days.

We understand that some of these records may contain your own personal data, and as such, we are happy to release this under the Freedom of Information Act on the basis that you have consented for your data to be shared in this manner.

However, please be aware that What do they Know is a public forum, and as such, we would encourage you to provide us with another email address for communication, in order to ensure the safety and security of your own personal data.

Dear Mr Mitchell

Further to the below email, we can confirm that we are currently processing your request for an internal review to be carried out into the handling of FOI request [CPFT FOI F24-483].

However, we have come to the decision that as the FOI request you have submitted for ‘all documents related to the handling, processing, administration, complaint about or the making of my FOI request regarding service visits’, would contain your own personal data, and in addition, information concerning the complaint you have submitted would contain your own personal data, we require a different email address to be provided to us for correspondence in regard to these requests, as WhatdotheyKnow is a public forum.

We have placed these requests on hold, while we await confirmation of another email address for correspondence.

Kind Regards,

Dear CPFT,

There is nothing in the regulations that permits placing an FOI request on hold when you have the permission of the data subject in question to release the data, including in a public forum. I expect the original timescales to be honoured and my request to be enacted, if this is your final response kindly state so and I will refer it to ICO to consider.

Were I to give you my email address I assure you the information would be uploaded to this website regardless, in addition I would have to publish my email on this forum and and for these reasons I therefore refuse your request. If it is a matter of confirming my identity to release the information I would be happy to send you a certified copy of my passport or driving license.

I would also note that my photo and information are on your website which means in this instance I would be considered a public figure for the purpose of an FOI requests.

Yours sincerely,

Anthony William Mitchell

Dear Mr Mitchell

After further review, we are happy to continue to use your Whatdotheyknow email for communication, as you have consented for your personal data to be released to this address.

However after discussion with our team and with the ICO, we will now be processing your requests as follows:

• I am sadly forced to make an FOI for all documents related to the handling, processing, administration, complaint about or the making of my FOI request regarding service visits, due to communications being sent to my Governor's email rather than to this website. To further complicate matters some correspondence may now also considered my personal information as this was a personal FOI request and not one made by a Governor. As the data subject I give my permission for this information to be released.

The above request will now be processed as a Subject Access Request, as this relates to the FOI request that you have made (as an individual). Therefore we believe that this information constitutes personal data.

As such, we have passed this request onto our Access to Records Team, who will be in contact to request any supporting information required from you.

We note that you have also raised the below complaint as you are dissatisfied with the handling of your FOI request.

• Given the circumstances I also raise a complaint over how my personal information was shared by the CPFT and for a response being incorrectly sent to my CPFT email creating this unfortunate issue.

This will now be investigated as part of our internal review process. According to the ICO, if a complaint relates to the outcome of and / or handling of a request for information, this should be processed as an internal review.

We apologise for the delay in clarifying this information with you, however, please do not hesitate to contact us, should you require any further information.

Natasha Wharton

Dear Freedom of information,

Under the circumstances I feel I have no choice but to refer this to the ICO.

While this is your final response I advise you that, the CPFT has already requested and recieved the indentity information for a GDPR request. I also note that I do not need to use the term GDPR request to make it so. I maintain that an FOI request is the more appropriate mechanism.

Finally I ask that you retract the statement that there may be a "personal grievance you have in relation to your role as Governor within the Trust."

I would require strict proof for any such allegation or defamation of my character.

Yours sincerely,

Dear Mr Mitchell

Thank you for your email. Please see our responses below (in bold).

While this is your final response I advise you that, the CPFT has already
requested and received the identity information for a GDPR request. I also
note that I do not need to use the term GDPR request to make it so. I
maintain that an FOI request is the more appropriate mechanism.

As previously advised, we have passed your request for the below
information to our Access to Records Team:

• All documents related to the handling, processing, administration,
complaint about or the making of my FOI request regarding service
visits.

We can confirm that this will be treated as a Subject Access Request, as
this relates to your personal data. We will not be processing this request
under the FOIA.

If you wish to receive further copies of your personal email
correspondence, we recommend that you submit an additional Subject Access
Request to our Access to Records Team at
[1][email address].

Finally I ask that you retract the statement that there may be a "personal
grievance you have in relation to your role as Governor within the Trust."

I would require strict proof for any such allegation or defamation of my
character.

We are sorry that you are unhappy with this statement. It is not our
intention to make any allegation or in any way to be defamatory towards
you. However, when responding to FOI Requests, it is sometimes necessary
to consider the motive of the requester when considering a request under
the Freedom of Information Act.

Anthony William Mitchell

Dear Cambridgeshire and Peterborough NHS Foundation Trust,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Cambridgeshire and Peterborough NHS Foundation Trust's handling of my FOI request for information regarding my FOI request entitled 'A request for Information regarding service visits and Councillors attending'.

While the CPFT may have chosen to enact a GDPR request, that was not the original request made and I have the right to request an internal review of your decision.

The reason for an FOI request over a GDPR request is both the scope of the request and removing the need to redact the names of those at a senior and public facing level.

I would respectfully note that your redaction was poorly undertaken, given that that the people involved are largely at a senior and public facing level it is easy to identify them using the CPFT website, you also failed to redact one name.

My request is also missing two emails, while I can not be specific in their content as they have yet to be released they occurred on the 09/01/2024 00:22 and 09/01/2024 08:35 on my CPFT email. Again had you reached out internally I would have volunteered the information to the CPFT.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/a...

Kind Regards,

Anthony Mitchell

Dear Mr Mitchell

Thank you for your email.

We note that we already carried out an internal review into the outcome / handling of your FOI request [CPFT FOI F24-483], and a response was provided to you on 29th January 2024.

The Trust is not required to carry out multiple internal reviews regarding the same FOI request.

If you are dissatisfied with our internal review response, you have the right to contact the ICO to appeal our decision.

As we believe that your concerns regarding missing emails relate to a Subject Access Request you have submitted, these have been passed to our Access to Records Team for further review.

Dear Freedom of information,

My request for an internal review clearly relates to my FOI request of the 9th January 2024 and not the 7th December 2023.

These are two separate FOI requests and while you processed the 9th January 2024 request as a GDPR request I did not agree to this and as such I have the right to request an internal review.

If you are unwilling to do this kindly state so in a final response deadlock letter and I will refer my complaint directly to the ICO.

I note the timescales start from the date of my original request for an internal review.

Kind Regards,

Anthony Mitchell

Freedom of information, Cambridgeshire and Peterborough NHS Foundation Trust

Dear Mr Mitchell

The internal review process is used strictly for complaints relating to the handling of, or outcome of a Freedom of Information (FOI) Request.

As your request dated 9th January 2024 related to your own personal data, this was logged as a Subject Access Request (and not an FOI Request). Therefore, this ultimately falls outside of the scope of the internal review process.

If you are dissatisfied with our decision to log this request as a Subject Access Request, we would advise that you contact our Complaints Team at [email address] or alternatively contact the Information Commissioner's Office at the below address:
