A current list of members of the Justices' Clerks' Society held by HMCTS 2017

We're waiting for Mr Tapi to read recent responses and update the status.

Dear Sirs,

Please kindly supply me with the following data you may hold; under authority of the Freedom of Information Act 2000 ('FOIA'), s.1, s.3, s.6 and s.8:

1. A current (up to date) list of all members of the Justices' Clerks' Society also known as JCS (of HMCTS, 3rd Floor, Temple Court, 35 Bull Street Birmingham B4 6EQ or other location), to include their title and department as at 12 December 2017.

2. A current document or statement of (link to relevant HMCTS website may be acceptable where data is held) aims and objectives, mission statement, vision, remit etc., as at 12 December 2017.

A timely response in compliance with the Freedom of Information Act 2000 ('FOIA'), s.10 will be greatly appreciated.

Dear Sirs,

Please accept this correspondence as formal written request for an internal review, owing to inadequate (or deficient) response by HMCTS on information(s) requested on 12 December 2017; whereas HMCTS are in default of Freedom of Information Act 2000 (‘the Act’), s.10.

Reasons now given as to request for an internal review are as follows:

1) If an authority is relying on one of the exemptions in Part II of the Act to either refuse to confirm or deny whether information is held or to refuse to provide information, then under section 17(1) of the Act it has a duty to issue the requester with a refusal notice within the time for compliance with section 1(1) of the Act.

2) The time for compliance with section 1(1) of the Act is defined by section 10(1), which means that the notice must be issued promptly and within 20 working days of the date of receipt of the request.

3) If only some of the requested information is exempt, then the authority will still have to comply with its section 1(1) duties in respect to any information which is not covered promptly and within 20 working days.

4) Under section 10(1) of the Act it states that an authority must comply with section 1(1) of the Act ‘…promptly and in any event not later than the twentieth working day following the date of receipt.’ And therefore liability befalls any Public body under lawful statutory duties of section 10;

a) This means that when an authority is not relying upon a part II exemption and does hold the requested information, it will need to both issue the requester with written confirmation of this and provide the information promptly, and within 20 working days, in order to comply with its obligations under section 10(1); and

b) If the authority is not relying upon a part II exemption and does not hold the information then its only requirement under section 10(1) will be to inform the requester of this in writing promptly and within 20 working days; and

c) It also follows that a general response (such as a holding letter or acknowledgement) issued within 20 working days, but which fails to confirm or deny whether the information is held, or provide information, will not be sufficient to comply with the requirements of section 10(1).

5) The obligation to respond promptly means that an authority should comply with a request as soon as is reasonably practicable. An authority will therefore need to both respond promptly and within 20 working days in order to comply with section 10(1) of the Act.
