I am writing in response to your request for information (ref FOI 5259885
).

 

The relevant Council Service(s) has searched for the requested information
and our response is as follows.

                                  

Subject: A6 to Manchester Airport Relief Road Tender (A6MARR)

I would like to have an electronic copy of the Quality (Technical)
submittal for the A6MARR project, which was delivered by Carillion Morgan
Sindall Joint Venture (CMS JV)

 

The Quality (Technical) submittal for the A6MARR project was part of a
competitive offer for this work and the Council remains in contract with
the contractor. The Council has consulted with the contractor who has
confirmed that the document remains commercially sensitive. The document
is therefore considered exempt from FOI, based on the following:

 

The exemption applied under the FOI Act is Section 43(2). This exemption
applies in that to disclose the information would, or would be likely to,
prejudice the commercial interests of the Council in securing best value
from its suppliers, and further would prejudice the commercial interests
of third party organisations that do business with the Council, and whose
trading position could reasonably be expected to be weakened were they
made public.

 

Reasons in favour of disclosure :

o Stockport Council is committed to transparency and releasing this
information would be in line with that.

 

Reasons against:

              The specific reasons the public interest is best served by
withholding the information is that:

o the information requested is commercially sensitive and is likely to
prejudice the interest of the suppliers that provided the submission;
and
o the information requested is likely to prejudice the interest of the
authority by negating the ability of fairly and competitively
appraising submission for the same (or similar) services in the
future.

 

         In consideration the reasons against outweigh the reasons in
favour and the exemption is applied.

must do so within 40 working days of the date of this response. Any
internal review will be carried out by a senior member of staff who was

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Stockport Metropolitan Borough Council's handling of my FOI request 'A6 to Manchester Airport Relief Road Tender (A6MARR)'.

The grounds used to justify not disclosing the requested information are not justifiable, for the following reasons:
• The release of the requested information will not affect the supplier negatively due to the fact that the supplier (Carillion) have dissolved and ceased public trading
• The release of the requested information will not affect the procurement authority because the information requested is project specific, over 5 years old and thus can’t not be replicated to other tenders.
• Additionally, the project itself is already delivered and the A6MARR is currently operational.

Dear Mr Al-Sharief,

 

I am writing in response to your request for an internal review of FOI
5259885(IR 5296755).

 

I have conducted an impartial reassessment of your original request and my
findings are as follows.

 

I am upholding the decision made from the Information Governance Officer
who handled your request. I came to this decision based on the following
matters:

 

o The information requested is commercially sensitive and is likely to
prejudice the interest of the suppliers that provided the submission;
o The information requested is likely to prejudice the interest of the
authority by negating the ability of fairly and competitively
appraising submission for the same (or similar) services in the
future;
o We are currently within an active contract which is classed as
commercially sensitive as it could be used by competing companies for
other tenders; and
o Even though Carillion have gone out of business Morgan Sindall have
taken full control of the contract of which is active until the end of
November 2030.
