Freedom of Information Request – FOI2022/00860
I am writing in response to your email received by Post Office Limited
(“Post
Office”) on 23 December, in which you asked:
Is the provision of Horizon evidence free, yes or no?
Has some evidence been supplied free, yes or no?
Did Fujitsu always charge POL for Horizon data, yes or no?
Post Office considers that your email does not contain a request for recorded
information. Although your request can be in the form of a question, rather than a
request for specific documents, the Freedom of Information Act 2000
(“FOIA”) does
not oblige an authority to answer a question if this would mean creating new
information or giving an opinion or judgment that is not already recorded, which
applies to the question you have raised.
We deal with requests that do not fall under the FOIA through standard business
enquiry processes rather than as a formal request for information, therefore in answer
to your question, it is worth noting that any Horizon data is provided by Fujitsu under
the contract between Fujitsu and Post Office.
I refer you to the response we provided under FOI2022/00785 and which refused your
request under the section 12 FOIA cost limit, which said:
“We can confirm that regarding your question about the previous response
under FOI2022/00733, Fujitsu are obliged to provide 720 Audit Record Queries
(ARQ) to Post Office per year, before any additional charges are incurred.”
“…to find out how many Postmasters requested Horizon data for their branch
specifically to assist a legal defence; and to locate the number of Horizon data
provide along with any charges to Postmasters, would be a massive exercise
that would require Post Office to go through each request for Horizon data over
a number of years.”
We have nothing further to add on the matter and would once again like to refer you
