Request – 2022-09
I refer to your Freedom of Information request received on the 15th February 2022.

Your Request
You asked:
As part of the Climate Change Agenda following COP26 we are compiling a list of
Organisations who do not comply with current legal requirements under The Energy
Performance of Buildings Regulations (England and Wales).

You have been noted as an offender, specifically in respect of buildings containing
air conditioning. Part 4 Inspection of Air Conditioning Inspections of the EPB refers.

Questions;
1.  Were you aware of the Regulation?
2.  Provide a time-scale in which you intend to comply? We will check for your
compliance certificate on the open government database:
Find energy certificates and reports by postcode – Find an energy certificate –
GOV.UK (communities.gov.uk).

3.  If you do not intend to comply, why not?
4.  Who is the Responsible Person at your Organisation?
5.  Do you have a Sustainability Plan or Carbon Reduction Programme?

Our Response
We confirm that the information requested under Section 1 of the Freedom of
Information Act 2000 (the “Act”) is held by NCG and is provided below.
1.  Were you aware of the Regulation?
Yes
2.  Provide a time-scale in which you intend to comply? We will check for your
compliance certificate on the open government database:
Find energy certificates and reports by postcode – Find an energy certificate –
GOV.UK (communities.gov.uk).

We believe we do comply with this regulation as we are not required to
have an EPC, and do currently have a valid DEC and TM44 report in
regards to our air conditioning. If this is not what your request is in
relation to, please can you be more specific in your request?

3.  If you do not intend to comply, why not?
Covered above
4.  Who is the Responsible Person at your Organisation?
Pam Griffiths – Estates Manager
5.  Do you have a Sustainability Plan or Carbon Reduction Programme?

NCG has a Sustainability strategy, where we aim to reduce our scope 1
& 2 emissions by 50% from our 2018/19 academic year by 2030. Details
of this can be found on our website.

If you have any further enquiries about this matter, please do not hesitate to contact.

Kind regards,
David Balme
Executive Director and Secretary to the Board
