The Scottish Information Commissioner has advised that the Freedom of Information
(Scotland) Act 2002 (FOISA) “gives a right to information, not to documents”. Please
see the PDF available here:
http://www.itspublicknowledge.info/Law/FOISA-
EIRsGuidance/Information_or_documents/Information_or_documents.aspx
This document states, in paragraph 13:
“A lot of information requests made to public authorities refer to specific
documents. As noted in paragraph 5, under section 8(1)(c) of FOISA, a
requester must describe the information they are requesting for a request to
be valid. FOISA does not set out how information must be described, but the
purpose of this description, as section 1(3) makes clear, is to allow a public
authority to identify and locate the information.”
We are therefore unable to provide information in response to your request as we do
not know what information, specifically, you are seeking.
Under s.15 of the Act we are required to provide advice and assistance – to this end,
it may help if you specify the information you require in the form of one or more
questions and submit a new request. Please let us know if you require any
assistance with this.
