I refer to your recent request for information under the Freedom of Information Act
2000 (“
FOIA”), as set out below:
“…
On 21st March 2019, POL issued an application to recuse Mr Justice Fraser,
the High Court Judge presiding over the Group Litigation.
Please can you release minutes (and attendees) of the POL Board and GLO Sub-
Committee meetings at which this course of action was discussed and decided.
On 9th April 2019, POL delivered an appeal against the Judge’s refusal to recuse
himself. Please can you release minutes (and attendees) of the POL Board and
GLO Sub-Committee meeting at which this course of action was discussed and
decided...”
At present our view is that your request falls within the scope of certain qualified
exemptions, including legal professional privilege under section 42 FOIA and information
which is likely to prejudice commercial interests under section 43 FOIA. As permitted
by section 10 FOIA, Post Office Limited (“
Post Office”) requires further time to consider
the public interest test in relation to this exemption. In accordance with paragraph 4.6
of the Code of Practice, Post Office considers a 20 working day extension would be
appropriate at this stage and will therefore aim to respond to you by 19 January 2021.
