Dear Mr Roberts
Request for information: RFI-2020-0379
Thank you for your request for information received on 28th April 2020 concerning expanded retail
discount. This request has been handled under the Freedom of Information Act 2000.
I can confirm that Newark and Sherwood District Council holds the information you requested.
Unfortunately some of the information has had to be redacted under section 40(2) of the Freedom
of Information Act 2000.  Section 40(2) exempts personal information that is not that of the
applicant from disclosure, the condition set at 40(3)(a)(i) states that where disclosure would
contravene any of the principles in the Data Protection Act 2018 and the General Data Protection
Regulation, the exemption is absolute and therefore does not require the public interest test to be
considered.  In this instance I am of the opinion that if the information in question were to be
provided the Council would be in contravention of principle one, fair and lawful processing.  The
information being withheld is details for Sole Traders.
Therefore, in respect of this part of your request and in accordance with the Freedom of Information
Act this letter acts as a Refusal Notice.
Please see attached for the redacted information the Council holds.
If you have any further queries or concerns about the information provided please do not hesitate
to contact us. If we do not hear from you within 40 days, starting the day after the date of this letter,
we wil  consider the request closed.
If following our response to your query you are stil  dissatisfied you have the right to request an
internal review.  This wil  be conducted by a member of the Senior Leadership Team who has not
been involved with the request or complaint until this point.  Should you wish to proceed to this
stage please advise us quoting the reference number at the top of this page.
Should you be dissatisfied with the outcome of any internal review to the Council you have a further
right of appeal to the Information Commissioner’s Office, details of which can be found on the
Information Commissioner’s website

More details of this complaints process are available to view on our website at the fol owing link:
There is no charge for making an appeal at any stage.
Yours sincerely
David Clarke
