on the council’s website at the following link: Advanced Search

Firstly please accept my apologies for the delay in responding to you.
Your request has been review again and the information we hold which
relates to your request is as follows:
1. how many 5G towers have been fitted in the District of Bolsover? A
register of this information is not held by the Council. Please note
that not all masts require planning permission. I include some
guidance from the Government that explains this:

Some information is held by the Council in the form of planning
applications and these can be searched on our website, please see guidance
below.
2. How may are LIVE and switched on (if not all) ? As above

I can confirm that the Council will hold some information in relation 5G
masts through the Planning process. However, this information is exempt
under Section 21 (information reasonably accessible to the public) of the
FOI Act because Planning applications are publicly available on the
Council’s website.
This exemption means that Council, as a public authority, does not have to
provide requested information that the requesters could reasonably easily
obtain for themselves.
I can confirm that, on reflection, our original response did not provide
you with sufficient information to enable you to reasonably identify the
information you had requested. Using the word “mast” in the search
facility identified 145 possible applications, many of these related to
the word “Master”.
By way of advice and assistance, I can advise that the information can be
searched for on our website [2]www.bolsover.gov.uk and the specific page
of [3]https://publicaccess.bolsover.gov.uk/onl...
I have spoken with the planning department who have confirmed that if you
use code “DETT56” in the key words box, this will provide you with
applications relating to telecommunications. This will reduce the number
of applications to 53. Please note that the search facility is not
comprehensive and if the applicant does not contain the key words e.g 5G
then we cannot guarantee the accuracy of the information returned.
I have also undertaken a search of the planning portal and it appears that
the council has had two applications under the code “DETT56” since UK 5G
rollout began in 2019.
These are:

at base and associated ancillary works. | Land At Grid Reference 444289
355879 Lea Vale Broadmeadows South Normanton.
[5]23/00069/DETT56 | The removal of the existing 17m mast and its
replacement with a 21m tower supporting 6 no. antennas and 2 no. 0.3m
dishes (1no. relocated). | Telecommunications Mast 10076 Westfield Lane
Barlborough.

Re: Your FOI Internal Review Complaint received on 21st March 2023.
I am writing further to your Internal Review complaint received on 21st
March 2023 concerning the response to your request for information
(reference F/471/2223) , which you made under the Freedom of Information
Act 2000. I have now reviewed your complaint with the Information,
Engagement and Performance Manager, and have the following information:
The Information, Engagement & Performance Manager has reviewed the
information provided to you under FOI request (ref: F/471/2223) and notes
the following:
You made a request for information held in relation to 5G masts. The
Information & Policy Officer sent an updated response on the 13th March
2023 to provide improved information on how to search for the information
on the Council’s public access system which is a database of planning
applications. You sought an Internal Review as the Council stated that it
may hold information on Health & Safety Assessments, Environmental Impact
Assessments and Insurance Policy by virtue of the information supplied by
the planning applicant when making their application.
The Council is not obliged to provide information under FOI which is
reasonably accessible to the public. The Council publishes copies of all
planning applications and associated documents such as officer reports,
public comments, and statutory consultee comments, supplementary documents
supplied by or requested from the applicant. As such information about
planning applications and the administration of them are transparent and
readily available to the public. I understand that you have not raised any
concerns about your ability to access the information and therefore the
Information, Engagement & Performance Manager is satisfied that the
exemption has been applied correctly.
As noted in the Council’s FOI response, the original information provided
to you to help you undertake a relevant search of the public access system
was not as helpful as it could have been. As such the Information & Policy
Officer apologised for the inconvenience caused, provided improved search
information and advised you that when she undertook the search herself
that she found two relevant applications. The reference details for the
two applications were also provided. Upon review the Information,
Engagement & Performance Manager is satisfied that the Council has
discharged its duty to provide assistance under the FOI Act.
As noted in the Council’s FOI response the information sought by you is
only held by the Council by virtue of relevant planning applications. The
Council is not required by law to hold a register of 5G masts. That is why
the response stated that ‘some’ information may be held within the
relevant planning applications.
In order to assist you further the Information, Engagement & Performance
Manager has looked at the two applications and found two documents that
fall under the scope of your request as follows:
