Dear City of York Council,

I am reaching out concerning my comprehensive Freedom of Information (FOI) request dated 24 September 2023, which pertained to crucial details surrounding 5G mobile phone mast emissions and the affiliated health and financial implications.
As of today 22 October 2023, I have not received any acknowledgment or response, even though the stipulated 20 working day period, as mandated by the Freedom of Information Act 2000 (FOIA), has elapsed.

The importance of this matter is manifold. Firstly, the FOIA is not merely a statutory guideline but an embodiment of the democratic contract between public authorities and the citizenry. This law exists to ensure that public bodies operate with transparency, serving the public's right to be informed about actions and decisions that may impact them.

Your council, as a custodian of public welfare and trust, bears an elevated responsibility to honour this law.
Each day of delay not only breaches the FOIA but also incrementally erodes the trust that individuals, like myself, place in institutions such as yours.

When public bodies fail to disclose information promptly and without substantive reason, it raises grave concerns about their commitment to transparency and adherence to the laws of the land.

Secondly, the Nolan Principles, established to delineate the standards of behaviour expected of public office holders, champion the cause of "Openness." It is anticipated that decisions, actions, and any underlying reasons are made transparent unless there are overriding public interests to act otherwise.

In light of the above:

I urgently request an acknowledgment of this letter and the initial FOI request.
I implore you to expedite the provision of the requested information or, if certain aspects are exempt, to furnish clear, substantiated reasons in line with the FOIA's provisions.
I seek clarity on a definitive date by which I can expect the complete information or a response to my queries.
If, for any reason, the City of York Council is not the appropriate authority for some parts of this request, I urge you to guide me to the right entities.

The relationship between public authorities and the people is a delicate one, anchored in trust and mutual respect. By upholding the laws of disclosure and ensuring timely communication, we reaffirm the strength and integrity of this bond.

I trust that you will address this matter with the urgency and seriousness it warrants.

Yours faithfully,

:stuart-Leslie:

Dear Mr Leslie,

Please see below the response to your enquiry under the Environmental
Information Regulations (EIR).

Part 1: 5G Mobile Phone Mast Emissions - Technical and Health Aspects

Given the increasing public interest in electromagnetic fields (EMF) and
their potential health effects, I respectfully request the following
information pertaining to 5G mobile phone masts within our jurisdiction:

1.    Please provide a comprehensive list of all 5G mobile phone masts
currently installed and operational within our local council's area.
Include precise geographical coordinates (latitude and longitude) of each
mast, the companies or entities responsible for their operation, and the
dates of activation.

The information requested is considered reasonably accessible by other
means. The exception under Regulation 12 (4) (b) allows the Council to not
provide the requested information as the applicant can reasonably locate
and retrieve the information easily.

It is possible for you to check the planning application records via the
Council’s online database using the search page:
[1]https://planningaccess.york.gov.uk/onlin...

Within the Advanced tab enter 5G in the Description Keyword box and this
will locate the information the council holds on this.

Public Interest Test

Bearing in mind the above, the Council has carried out a public interest
test as to whether the information held should be disclosed. It is
accepted that there will always be public interest in disclosure to
promote transparency and accountability of public authorities, greater
public awareness and understanding of environmental matters, a free
exchange of views, and more effective public participation in
environmental decision making. However, in this instance it is considered
that the public interest in disclosure of this particular information
would not be justified given that the information on planning applications
is already public domain and realistically accessible.

2.    Specify the frequency bands utilized by each of these 5G mobile
phone masts, with particular emphasis on any frequencies operating at or
near 18 GHz. Additionally, provide detailed technical specifications
related to power levels, antenna configurations, and compliance with
international safety standards.

This information is not held

3.    Share records of electromagnetic field (EMF) safety assessments or
studies conducted on each of these 5G mobile phone masts. These
assessments should cover potential health implications and compliance with
safety guidelines. If no such studies exist, kindly confirm this.

This information is not held

To assist with your enquiry UK Health Security Agency (UKHSA) provides
advice on potential health risks and protection from exposure to the radio
waves from telecommunications systems, including those providing 5G
services. Its latest advice based on the available research is available
at the following link: [2]5G technologies: radio waves and health - GOV.UK
(www.gov.uk)

Based on an assessment of the evidence, the UKHSA has concluded it is
possible that there may be a small increase in overall exposure to radio
waves when 5G is added to an existing network or in a new area. However,
the overall exposure is expected to remain low relative to international
guidelines on limiting exposure and, as such, there should be no
consequences for public health. The UKHSA continues to review the evidence
applicable to 5G and other radio technologies and will update its advice
as necessary.

4.    Provide all documentation related to public inquiries, concerns, or
complaints regarding EMF emissions from 5G mobile phone masts within our
jurisdiction. Include any responses or actions taken by our local council
or relevant authorities in addressing these concerns.

See Q1

Part 2: Funding Sources for 5G Mobile Phone Mast Installations.

To ensure complete transparency and accountability in matters concerning
the deployment of 5G mobile phone masts, I kindly request detailed
financial information as follows:

5.    Present a comprehensive breakdown of all funds received by our local
council from third parties, including incorporated and non-incorporated
entities, non-governmental organisations, government bodies, and military
organisations. Specify the total amounts received, the sources of these
funds, and the specific purposes for which these funds were allocated.

Information not recorded

6.    Disclose all agreements or contracts established between our local
council and external parties for the installation, maintenance, or
operation of 5G mobile phone masts. Include the terms and conditions,
durations of agreements, and any financial commitments or incentives
involved.

Information not recorded

If you are dissatisfied with our response you have the right to ask for an
independent review of how your enquiry was handled and responded to. This
can be done by contacting us at [3][City of York Council request email]
within 40 working days of receiving your response, stating your reason(s)
why you are dissatisfied.

If you remain dissatisfied following the internal review response you can
contact the Information Commissioner, contact details below:

Dear City of York Council - Corporate Governance Team,

I am writing to express my grave concerns regarding the responses provided to this enquiry, under the Environmental Information Regulations (EIR) dated 24 October 2023.

The information requested is vital to ensure public safety, transparency, and accountability on issues as significant as 5G installations.
5G technology is a matter of substantial public interest given its implications on health and safety, especially related to the potential health effects of electromagnetic fields (EMF).

While I understand that some information might be accessible through online databases, it is disappointing to see the Council not directly providing such crucial details. Placing the onus on the citizen to navigate potentially complex databases is neither citizen-friendly nor transparent.

It is deeply concerning to see the lack of information regarding the technical details of the 5G masts, particularly in terms of frequency bands, power levels, antenna configurations, and compliance with international safety standards. Such omissions prevent the public from forming an informed opinion about the technology they are exposed to.

Moreover, the lack of electromagnetic field (EMF) safety assessments on 5G mobile phone masts within the jurisdiction is alarming. While references to the UKHSA are appreciated, the local council should take a proactive approach in ensuring the safety of its residents. Depending solely on national agencies for critical health data seems to abdicate local responsibility.

Additionally, the lack of documentation regarding public inquiries and concerns on EMF emissions is disheartening. It either suggests that the public's concerns are not being adequately recorded or that the Council is choosing not to disclose such concerns. Either scenario is worrisome.

Finally, the absence of records related to funding sources and contracts about 5G installations is hard to reconcile with the standards of transparency and accountability. Such omissions naturally lead to speculations about conflicts of interest and the integrity of decisions made by our local authorities.

The health, safety, and well-being of the public should be at the forefront of every decision the Council makes. The people deserve transparency, especially on issues as important as 5G technology. I urge you to reconsider the handling of such enquiries and prioritize the well-being and informed consent of your constituents

Yours sincerely,

:stuart-Leslie:

Subject: Request for Internal Review: EIR Response 24 October 2023 – Inadequate Disclosure of Information

Dear City of York Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review regarding the handling of my Environmental Information Regulations (EIR) request, dated 24 October 2023. My original request sought detailed information on the deployment of 5G technology within the City of York Council's area, an issue of great public interest due to its implications for health and safety.

I find myself dissatisfied with the response for the following reasons:

1. Accessibility of Information on 5G Masts:
The response directs to the Council’s online planning database to locate information on 5G masts, which does not constitute direct provision of information as per EIR expectations. The process is cumbersome and assumes a level of search proficiency that may not be present for all citizens. This is contrary to the principles of easy access and transparent governance.

2. Technical Specifications and Safety Assessments:
The Council's claim that information on frequency bands, power levels, antenna configurations, and compliance with safety standards is "not held" is troubling. The absence of such critical information suggests a gap in oversight and records management concerning public health and safety.

3. EMF Safety Assessments and Studies:
By stating that "This information is not held," without any indication of whether the Council plans to hold such information in the future, there seems to be a significant void in proactive measures to ensure community health and environmental safety in relation to 5G implementation.

4. Public Inquiries and Funding Details:
The lack of response to concerns and complaints filed by the public, and the absence of recorded funding sources and contractual agreements, inhibit public understanding and insight into the 5G network's deployment. This omission undermines public trust and the ability to engage in informed dialogue regarding local environmental developments.

Given these points, I believe that the Council has not met its obligations under the EIR to facilitate the public's right to information on environmental matters. An internal review would reaffirm the Council’s commitment to transparency and accountability. I trust the review will address these shortcomings and provide:

A). A complete list of all 5G masts in a citizen-friendly format.
B). Disclosure of any held information regarding technical specifications and EMF safety assessments.
C). Documentation or a statement of action towards recording and responding to public inquiries related to 5G masts.
D). Clarification on the Council's practices for recording financial transactions and contracts relating to 5G technology installations.

Please understand that this request is made in the public interest, and my intention is to work towards constructive resolution of these concerns. Should the internal review fail to provide a satisfactory outcome, I will consider further action with the Information Commissioner’s Office (ICO).

I look forward to a more complete and informative response following this review. Thank you for your attention to this matter.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/5...

Yours faithfully,

Dear City of York Council,
I am writing to follow up on my previous communication dated 5 November 2023, regarding my request for an internal review of the handling of my Environmental Information Regulations (EIR) request, dated 24 October 2023.

As of today, I have not received acknowledgment of my request for an internal review.
I understand that these processes take time, but I wish to emphasise the importance of a thorough and timely examination of the concerns raised, given the significance of the subject matter – the deployment of 5G technology and its potential implications for public health and safety within the City of York Council's jurisdiction.

To recap, my dissatisfaction with the initial response stems from the following key points:

1. Accessibility of Information on 5G Masts:
The response directed me to the Council’s online planning database, which falls short of the direct provision of information as expected under the Environmental Information Regulations. This process may be cumbersome for many citizens, compromising the principles of easy access and transparent governance.

2. Technical Specifications and Safety Assessments:
The Council's assertion that critical information on frequency bands, power levels, antenna configurations, and compliance with safety standards is "not held" raises concerns about oversight and records management related to public health and safety.

3. EMF Safety Assessments and Studies:
The statement that information on EMF safety assessments is "not held" without indicating any plans to acquire such information in the future indicates a potential gap in proactive measures to ensure community health and environmental safety concerning 5G implementation.

4. Public Inquiries and Funding Details:
The lack of response to public concerns, complaints, and the absence of recorded funding sources and contractual agreements inhibit public understanding and trust. This omission hampers the ability to engage in informed dialogue regarding local environmental developments.

I believe that addressing these concerns through an internal review is crucial to upholding the Council’s commitment to transparency and accountability. Therefore, I kindly request an update on the status of my request for an internal review and an estimated timeline for its completion.

In the interest of fostering constructive resolution, I would appreciate your assurance that the internal review will comprehensively address the shortcomings outlined in my initial communication. Specifically, I seek:

I understand that your commitment to transparency aligns with the public interest, and I look forward to a more complete and informative response following this review. If, for any reason, there are delays or additional information is required, please communicate this promptly to ensure clarity in the process.

Thank you for your attention to this matter, and I anticipate a prompt and thorough review.

Yours faithfully,
:stuart-Leslie:

I am writing to follow up on a previous Freedom of Information regarding the deployment of 5G mobile phone masts within our local council area. I appreciate the council's prompt response to my initial inquiry. However, I seek further clarification on certain points where it was indicated that the requested information is not held.

Specifically, I would like to address the following queries:

1). Frequency Bands and Technical Specifications: The response stated that detailed technical specifications, including frequency bands utilized, power levels, antenna configurations, and compliance with international safety standards, are not held. I would like to understand the reasons behind the lack of this information and whether the council has any oversight mechanisms or procedures in place to ensure compliance with safety standards for 5G mobile phone mast deployment.

2). Electromagnetic Field (EMF) Safety Assessments: It was stated that records of EMF safety assessments or studies on 5G mobile phone masts are not held. I would appreciate further clarification on why such assessments were not conducted or documented, considering the public interest in ensuring the safety of electromagnetic radiation exposure from telecommunications infrastructure.

Additionally, in the interest of transparency and accountability, I would like to reiterate my request for the following financial information related to 5G mobile phone mast deployment:

3). Financial Breakdown of Funds Received: Despite the response indicating that the information is not recorded, I am keen to understand if there have been any financial contributions or allocations from third parties towards the deployment of 5G infrastructure within our local council area. If no such funds have been received, please confirm this in writing.

4). Agreements with External Parties: Similarly, I seek clarification on the absence of recorded information regarding agreements or contracts established between the council and external parties for the installation, maintenance, or operation of 5G mobile phone masts. If no such agreements exist, please provide confirmation to that effect.

I understand that obtaining certain information may require coordination with relevant departments or external entities. Nevertheless, I believe that transparency and public accountability are essential, especially regarding matters that may impact public health and community well-being.

I kindly request that the council undertake a thorough review of its records and procedures to address the aforementioned queries and provide a comprehensive response within the statutory timeframe stipulated under the Freedom of Information Act 2000.

Thank you for your attention to this matter. I look forward to receiving your prompt response.

Yours sincerely,

:stuart-Leslie:
