Freedom of Information Act 2000 - Request for Information

 

I am writing in respect of your recent enquiry for information held by the
Authority under the provisions of the Freedom of Information Act.

 

Please find the response to your request below.

 

Could you tell me how cable laying and banging up 5g mast is front line
work

Wakefield Council is unable to provide a response to this part of your
request.  Under the Freedom of Information Act, for requests to be valid,
they must be requesting recorded information.  Although requests can be in
the form of questions, questions around opinions are not valid requests. 

 

Can you tell me how these mast have been tested for there safety and were
this information is available.

The planning system is governed by various pieces of legislation which are
made at a national level by the Ministry of Housing, Communities and Local
Government and subject to Parliamentary scrutiny. This legislation
establishes which types of development require planning permission from
the Local Planning Authority, and also sets out the consultation and
publicity requirements. Requirements on consultation and publicity vary
according to the type of development.

 

In addition, Central Government has exempted certain types of development
from the need to obtain planning permission through what are known as
‘permitted development rights.’ The nature of these rights differs but
typically allows works that are permitted development to be carried out
subject to certain limitations and conditions. For certain permitted
development rights, there is a requirement to notify the Local Planning
Authority of the works, but this does mean that the works require planning
permission from the Local Planning Authority. The relevant permitted
development right(s) establish whether public consultation is required for
the development in question.

 

There are specific permitted development rights in relation to
Communications development. These are contained within Part 16 of Schedule
2 of The Town and Country Planning (General Permitted Development)
(England) Order 2015 (as amended). The Electronic Communications Code is
also of relevance.

 

Where telecommunications (or other) works are permitted development, the
Council (as Local Planning Authority) cannot prevent the works being
undertaken as long as the works are within the scope of the relevant
permitted development right(s) and comply with any relevant conditions and
limitations. Should there be concerns that the works being undertaken are
not permitted development, then this can be reported to Planning
Enforcement to investigate. However, Planning Enforcement cannot take
action where works are permitted development – nor can they require that
an application for planning permission is made if the works are exempt
from the need to obtain planning permission.
