Thank you for your emails dated 16 April and 29 April 2024. I have
considered your request under the Freedom of Information Act 2000 (FOIA).
I apologise for the delay in my response.

 

I have interpreted your request as meaning a list of doctors who have had
concerns raised about them in which the five-year rule was engaged but
subsequently waived, meaning a decision was made to promote the concerns
to an investigation despite the five-year limitation period. I have
provided a link to further guidance in this area: [1]Guidance for decision
makers in applying the five-year rule.

 

I am unable to provide you with a list of doctors as requested in your
emails as this would breach data protection legislation. We believe it’s
reasonable for doctors and complainants to expect that complaints will be
treated as confidential. If a case progresses to a hearing, or an
investigation concludes with a warning or undertakings, certain
information may be made publicly available by the GMC, in line with our
publication and disclosure policy for fitness to practise information.
Otherwise the information is treated as the confidential personal data of
the doctor and other parties involved.  I have provided details of the
relevant exemption under FOIA below.

 

I can, however, provide you with figures relating to the number of
complaints where the five-year rule was waived. I note you have asked for
information for the last ten years, as well as details of the ethnicities
of the relevant doctors. Unfortunately, we are not able to provide data
for 2014 due to the unavailability of some data for this year. I have
therefore provided you with the data for 2015-2023.

 

Between 1 January 2015 and 31 December 2023, there were 54 complaints
relating to 54 individual doctors where the five-year limitation was
waived.

The exemption

 

Section 40(2), by virtue of section 40(3A)(a)

 

This exemption applies where the information is the personal data of a
third party and where releasing the information would breach any of the
principles relating to the processing of personal data listed at Article 5
of the General Data Protection Regulation (GDPR). In this instance
disclosure would breach the first principle, which requires the processing
of information to be lawful, fair and transparent. I do not believe that
any of the legal bases for processing listed at Article 6 of the GDPR are
met and therefore giving you the information would be unlawful.

Dear Henna Janghir,
In my original request I had asked 2 lists, list of doctors whose 5 year rule was waived and another list of doctors whose 5 year rule was not waived. You have given me a list of the first but not the second.
I would be grateful if you could give the ethnic details of the 7 that were erased.
Lastly, can you confirm that any one of the 7 was a student at the time of allegation.

Thank you for your email dated 20 August, in which you ask for a summary
of the 7 cases of the doctors who were erased following a Medical
Practitioners Tribunal Service (MPTS) hearing where the 5-year-rule had
been waived at the investigation stage. Just to clarify, there are 8
doctors in total, one of whom was a doctor but had been a medical student
at the time of the incident in question. I have considered your request
under the Freedom of Information Act 2000 (FOIA). Please find below a link
