Dear Liverpool City Council,

RICHMOND APART HOTEL, HATTON GARDEN, LIVERPOOL

At a hearing held on 28-30 January 2019 by THE ARCHITECTS REGISTRATION BOARD PROFESSIONAL CONDUCT COMMITTEE, findings of dishonesty were made in relation to the activities of Mr Stuart Duffy, a surveyor retained by the building contractor.

Mr Duffy issued Professional Consultant’s Certificates dated 8 May 2013
certifying practical completion in respect of apartments in the Richmond Apart Hotel, in
circumstances where the construction work had not in fact been completed. The
complainants were the owners of Apartments 412, 414 and 413 respectively.

Findings of fact were made, inter alia, that
"No doors had been fitted to the apartments;
The steelwork was exposed and had no fire protection;
...The apartments had no electrical installation and no plumbing, no bathroom
and no kitchen fittings..."

The Committee determined that Mr Duffy "acted dishonestly by certifying the works as being practically complete when they were not."

Do you accept that Mr Wilson also certified that these apartments (and others) were practically complete?

Is it correct that the apartments were not in fact complete and that the same findings made above could be addressed to Liverpool City Council?

Alternatively please explain how Derek Wilson determined that the apartments were practically complete in the above factual scenario?

Please disclose:

1. Copies of the certificates produced by Derek Wilson / Liverpool City Council in relation to apartments 410, 411, 801, 803, 407, 408, 409, 802, 412, 413, 414 in the Richmond Apart Hotel.

2. Copies of all memoranda and documentation referring to Liverpool City Council's production of completion certificates at this property.
