Your request for information has now been considered.
We have decided that your request is a repeat request that has recently been submitted and in
accordance with the freedom of information act 2000 section 14(1)(2), this letter acts as a refusal
The reason that we have concluded that your request is repeated is that we have received duplicate
requests from yourself within the last 60 working days which were refused. We have replied to your
repeat requests and informed you we will no longer be replying to requests for information already
released to you. In red below is the response from our SPOC for 2 requests you have submitted

The report that you made PRB_34770333 is not a new matter, this is the same issue that has been
investigated previously as part of the enforcement investigation therefore it has not been logged and
will not be acted on or investigated. We have explained several times previously that we will not
revisit the matter or the decision made.
As previously advised 'open space' does not necessarily mean ‘accessible space’.
Section 55 of the Town and Country Planning Act 1990 sets out the meaning of development which
includes the making of a material change in the use of any buildings or other land. To determine
whether a material change of use exists is a question of fact and degree. For there to be a material
change of use there needs to be some significant difference in the character of the activities from
what has gone on previously.
