Thank you for your Freedom of Information request which was received within the Trust. In
accordance with S.1 (1) (a) of the Freedom of Information Act 2000 (FOIA), I can confirm that
we do holds some information relevant to your request.
I’m writing to obtain the following information relating specifically to your NHS Trust under the
Freedom of Information Act 2000:
1. What is the number of serious incident reviews relating to clinical negligence at your
hospitals in 2016, 2017 and 2018?
2016: 6
2017: 6
2018: 17
2. What is the monetary value of successful clinical negligence claims made against your
hospitals in 2016, 2017 and 2018?
3. In the last three years (2016, 2017 & 2018), what is the number of settled negligence
claims where damages have been paid (number of cases and total monetary value) in
relation to:
- Allegations of late diagnosis / misdiagnosis

- Allegations of negligence leading to amputation
- Cases involving stillbirth or neonatal death
- Cases involving delayed diagnosis of cancer
- Cases involving medication errors
- Legal cases alleging clinical negligence which have taken more than 5 years to reach
The Trust is applying an exemption to questions 2 and 3 as we do not routinely collect this
information in the manner requested.
Section 12
This information in response to both questions is not routinely collected as this information is
not held centrally. We have established that it would take more than 18 hours to locate all the
information you have asked for, as it would require us to manually extract the information
which may be held in a number of locations. Therefore we consider that the exemption
offered to us in S.12 of the Freedom of Information Act 2000 relating to the cost of
compliance is applied, since we are of the opinion that the costs which we are allowed under
the Act exceeds £450. As you will be aware this is not an exemption which requires us to
consider the application of the public interest test.
