Dear Sir/Madam,
FREEDOM OF INFORMATION ACT 2000 - INFORMATION REQUEST No.0151
We have decided that your request is a repeat request that has previously been answered and
in accordance with the freedom of information act 2000 section 14(1)(2), this letter acts as a
refusal notice.
Our records show that an identical FOI request was dealt with and responded to in October
2018. Please find attached the FOI response 4795 sent to you on 01 Oct 2018 advising that we
do not hold the information requested.
We have no record of a S106 agreement ever being in place for this particular development.
Please be aware the information attached and within this letter has been sent directly to yourself
prior to this FOI response, following the various emails received by a number of departments
within the Council. 10 emails sent by yourself between 06 Feb 2019 and 14 Feb 2019 have
been responded to directly in a letter sent to you on 14 Feb 2019 by our complaints and
experience team who have covered the key queries you have made.
As explained earlier; A thorough investigation has taken place where the full history has been
looked at, all evidence has been considered and all views have been taken into account, legal
advice has also been sought on the issue. As far as West Lindsey District Council is concerned
the enforcement investigation for this matter is now complete and a decision has been made.
Unless new evidence is presented the council will not be revisiting the decision.
If you are unhappy with the way the council has dealt with this matter then the next stage would
be to make a formal complaint regarding the process that has been followed. You can make a
