Thank you for your email requesting a review of the department’s response dated 11 April 
(reference FOI 2019/06748), regarding an extension to the time limit for response to consider 
the public interest test.  
 
In your email you asked to be provided with information answering the following questions:- 
 
‘I am writing to request an internal review of Department for Work and Pensions's handling of 
my FOI request 'ESA - Contractual Performance Monitoring of CHDA Ltd (2018). 
 
I'm sure the Department knows it is "gaming" the system by abusing S.10(3) again. I'm sure it 
also knows that the ICO will send a letter telling it to issue its response without delay. As this is 
now a regular feature of how the Department handles RFIs I will be asking the ICO to take 
enforcement action against the Department when it deals with its inevitable refusal.’ 
 
Please be assured that your request has been given our full consideration and that all aspects 
of your review were taken fully into account. 
 
In response to your request, I can confirm that the handling of your original request and 
response has now been appropriately reviewed by someone unconnected with the handling of 
your original request.   
 
On 15 March, the department advised you that section 43(2) of the Freedom of Information 
(FoI) Act applied to the information that you originally requested on 17 February.  
By virtue of section 10(3) of the FoI Act, where public authorities have to consider the balance 
of the public interest in relation to a request, they do not have to comply with the request until 
such a time as is reasonable in the circumstances. Whilst 20 working days is the normal 
timescale for compliance, the department considered it appropriate to extend or vary this time 
limit due to levels of complexity when considering the commercial sensitivity of the 
management information requested. As the department had not yet reached a decision on the 
balance of the public interest, you were advised that we would not be able to respond to your 
request in full within 20 working days.  
 
On 11 April, the department again advised that as the balance of the public interest was still 
being considered, a response to your request was due by 15 May. A response in full to your 
original FoI request was issued on 2 May. 
 

I am satisfied that the response of the FoI Officer dated 11 April was correct and I uphold the 
decision in full. If you are not content with the outcome of the internal review you may apply 
directly to the Information Commissioner’s Office for a decision.
