            Q2       In relation to Q2, in accordance with Section 40(2)
of the Act the requested information cannot be disclosed, in order to
avoid the risk of possible identification of any children concerned.

The council acknowledge the requested information is statistical rather
than directly personal information. However, information is still personal
data even if it does not refer to individuals by name, if it meets the
definition of personal data in Article 4 of General Data Protection
Regulations (GDPR). “‘Personal data’ means any information relating to an
identified or identifiable natural person (‘data subject’); an
identifiable natural person is one who can be identified, directly or
indirectly, in particular by reference to an identifier such as a name, an
identification number, location data, an online identifier or to one or
more factors specific to the physical, physiological, genetic, mental,
economic, cultural or social identity of that natural person”.

The details of children accommodated in the specified care settings
relates to living individuals, due to the small number of settings used
for this purpose and then a small number of children placed in these
settings, that could be identified from the data, and other information
likely to come into your possession. The data provides particular
information about .

We are required under section 40(2) to take into account the GDPR
principles in particular Principle (a) – lawfulness, fairness and
transparency. The numbers of individuals combined with the type of
accommodation, and in the case of Q2, their status is small enough to run
a very real risk of identifying the individuals concerned. For this
reason, the council have considered the principles of the GDPR in our
decision as to whether to disclose the information. The council must also
consider whether it is fair in general terms to disclose the information.
The council has a duty of care to vulnerable children in the town to
ensure their safety, often these individual are some of the more
vulnerable members of our community. Due to the small numbers involved,
and the nature of the information requested, the council consider
releasing this personal information is likely to identify individuals. The
council have therefore determined that in this instance the disclosure
would contravene Principle (a) of the GDPR.

As the council is withholding some information as detailed above under
section 40(2) please accept this communication as a partial refusal notice
issued in accordance with section 17 of the Act.

of 16) need support to live independently rather than needing full-time
