I write with reference to your email 21 November 2018 which I referred to the Monitoring Officer.
Question: “I am writing to request an internal review of Cambridgeshire and Peterborough Combined
Authority's handling of my FOI request 'Employment Contract for Mayor's Adviser'.
A number of the 'Section 40' exemptions are qualified exemptions. Can you please therefore
demonstrate that the public interest test has been applied and explain your reasoning?”
His response is that, respectfully, your interpretation of the law is incorrect. His view is that, where
disclosure of the personal data of a third party would contravene any of the data protection
principles in the DPA, there is an absolute exemption from disclosure. The public interest test is not
therefore applicable. He is of the view that disclosure of the information requested would
contravene the first data protection principle in that it would be unfair to disclose the information
requested.
I trust that this is clear and we consider that your request for a review has been dealt with by this
response.
If you are not content with the outcome of the internal review, you have the right to apply directly
