We are unable to provide you with this information as this information falls within
the FOI exemption set out at Section 43 (Commercial interest).
Section 43(2) of the FOIA states that “information is exempt information if its
disclosure under the Act would, or would likely to, prejudice the commercial
interests of any person (including the public authority holding it)”.
The Trust is conscious of the importance of transparency in its use of public
funds. We believe that it is in the interests of both the NHS and the public for the
Trust to obtain the best possible prices. However, for the reasons stated above,
we are not convinced that the disclosure of this information would have the effect
of possibly lowering prices and could, instead, have the unwanted outcome of
settling a ‘benchmark’ for what the Trust will pay for services.
