521041 - Thomasson Park Cottages

The request was successful.

Christopher Banks

Dear Charity Commission for England and Wales,

In the land registry for title deeds MAN159158 it states:

"(23.04.2010) The Freehold land shown edged with red on the plan of the
above title filed at the Registry and being Land at Merehall Street,
Bolton."

"(23.04.2010) The deeds and documents of title having been lost the land
tinted pink on the title plan is subject to such restrictive covenants
as may have been imposed thereon before 23 April 2010 and are still
subsisting and capable of being enforced."

Please can you confirm if the land allocated in pink is Charitable land under the charitable trust Thomasson Park 521041. If this is not the case please can you provide any information as to which lost title deeds or covenant the land marked pink refers too.

Yours faithfully,

Christopher Banks

Dear Mr Banks

Thank you for your request for information relating to a specific area in
the title deeds identifying land relating to the charity Thomasson Park
521041. You have requested:

“Please can you confirm if the land allocated in pink is charitable land
under the charitable trust Thomasson Park 521041. If this is not the case
please can you provide any information as to which lost title deeds or
covenant the land marked pink refers too."

I have responded to your request for information under the Freedom of
Information Act 2000 and can confirm we do not hold this information.

It may be helpful if I explain that the Commission does not hold Land
Registry deeds. As such the area you have described as marked ”in pink” on
the Registry map is not available in our records to cross reference.

I have however looked at the Commission’s records for information relating
to any land that is held on charitable trust for this charity and can
provide you with a copy of the charity’s conveyance dated 4^th October
1889.

This includes a plan of the land referred to within the conveyance and may
assist you in cross referencing the area in pink marked on the Land
Registry plan you hold.

We do not hold any other land related information on this charity.

If you think our decision is wrong, you can ask for it to be reviewed.
Such requests should be submitted within three months of the date of our
response and should be addressed to the Charity Commission at PO Box 211,
Bootle, L20 7YX (email:
[1][email address]).  More information
about our Freedom of Information Act review service can be found on the
following link on our website:
[2]https://www.gov.uk/government/uploads/sy....

If, after this, you remain unhappy with the decision, you may apply
directly to the Information Commissioner (ICO) for a decision.  Generally,
the ICO cannot make a decision unless you have exhausted our review
procedure.  The ICO  can be contacted at the Information Commissioner’s
Office, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF (email:
[3][email address].)

Yours sincerely,

Ms Jan Provost (Freedom of Information and Complaints Manager)
