RE: EIRs REQUESTS 2483335, 2493733, 2483133
I am writing to you in respect of the above three requests which have been aggregated and are being 
considered under the Environmental Information Regulations 2004. Your three related requests are as 
follows:
EIRs 2483335 - In accordance with the Freedom of Information Act 2000 and the Environmental 
Information Regulations 2004, I request the following documents: 
Minutes of meeting, correspondence (paper or electronic), notes of phone calls, SMS records between 
Cheshire East Highways and the elected representatives of Nantwich concerning the decision to build the 
Edmund Wright Way and Taylor Drive link, Nantwich CW5 between January 2011 and January 2018.
EIRs 2493733 -
 Minutes of meeting and correspondence (paper or electronic) in respect of 'Traffic and 
Transport' statements and traffic studies between Cheshire East Highways and the Messrs Gladmans 
developers (and their traffic consultants) of Malbank Waters Estate, Queens Drive Nantwich CW5 
between 2011 and 2015.
EIRs 2483133 - In accordance with the Freedom of Information Act 2000 and the Environmental 
Information Regulations 2004, I request the following documents: 
Any document from Sustrans that describes the agreement to make a contribution to the costs of the 
pedestrian link built in 2011/2 in Edmund Wright Way and Taylor Drive Nantwich CW5.

Regulation 12(4)(b) – Manifestly Unreasonable
12(4) For the purposes of paragraph (1)(a), a public authority may refuse to disclose information to the 
extent that –
(b) the request for information is manifestly unreasonable

The EIRs allow public authorities to refuse a request for information that is manifestly unreasonable. The 
inclusion of the word “manifestly” means that there must be an obvious or clear quality to the 
unreasonableness.
The purpose of the exception is to protect public authorities from exposure to a disproportionate burden 
or an unjustified level of distress, disruption or irritation, in handling information requests.
The exception can be used:

when the request is vexatious; or

when the cost of compliance with the request is too great.
In this instance, the cost of compliance with the request is too great. It will take officers in excess of 18 
hours to be in a position to provide responses to the three requests. 18 hours is the appropriate limit for 
the answering of FOI Requests and can be used as a marker for the time taken to respond to requests 
under the EIRs. At present, the amount of time officers would take to respond to the requests in full is 
manifestly unreasonable. Responding would divert officers from their normal day-to-day duties to the 
detriment of other service users.
However, Cheshire East Council would consider a revised reduced request from yourself.

can be electronically via the planning portal.  Alternatively, the paper copies can be viewed in person at 
one of the authority’s customer service points. You can arrange to view the paper file contained within

I realise that there are quite a number of documents to go through. However, the information is available 
publicly without the need to request it through any formal disclosure process. Therefore, it is for the 
interested party to review all the available information before make a formal request for the information, 
which has not been proactively published.
Therefore, please review the information on the various planning application cases, which are all within 
the scope of your requests. Having done that, you can then make a new revised and reduced request for 
information.
EIRs 2483335 – can you please review the time period you want information for. Currently 7 years is too 
wide a timeframe. Can you also identify which officers you require information from. Finally, please 
identify which elected members you want information from. However, please be aware that 
correspondence exchanged by councillors in their capacity as a ward councillor is outside the scope of 
FOIA and the EIRs. Therefore, it is not caught by the legislation and consequently there is no right of 
access to this information through either set of legislation.
EIRs 2493733 – please identify which officers or services you believe will have liaised with Gladmans in 
relation to this matter. Please reconsider the timescale for this request.
EIRs 2483133 – I need more information from you in relation to this matter. Can you please give a 
timescale for this information? In addition, in respect of communications from Sustrans – can you please 
advise which department and/or officer of Cheshire East Council Sustrans are likely to have corresponded 
with and when this is likely to have occurred? At present, the request is too vague and too wide. The 
authority needs to be able to direct the request more specifically.
The three requests have been closed. However, the authority will consider a new reduced revised 
request from you once you are clear what information you require that is not already in the public 
domain.
