My understanding is that any application to discharge or partially discharge a requirement under the DCO is not subject to the Planning Fee Regulations and therefore there is no application fee payable. In that respect it is therefore the S106 that provides the means by which the LPA can recover the cost of dealing with the applications.

As you will appreciate from our meetings, it is very difficult, at this stage to identify what the costs will actually be, without knowing how many applications will be submitted and the amount of work, consultations, negotiations etc. required in each case. Based on your Stage Reporting spreadsheet and my own estimates I conclude that there could potentially be around 300 individual discharge submissions. The table attached is based on this assumption. The table shows the hourly rate for each officer/grade likely to be involved in the discharge process and this includes all relevant on-costs including car allowances, recharges to other council teams e.g. legal team, financial services, IT support etc.    

I hope Halite will be able to accept this figure as a “starter for 10” which can be refined as we go forward and are able to get more clarity on the amount and nature of the discharge applications as the development progresses.

I was hoping to speak to you today as a follow up to our recent meeting, to see if there was any additional information you required to assist in pulling together the rates and fees for the 9th October.

There is an option to copy over some of the information/reports that will be submitted for approval on the understanding that there is no commitment for Wyre Borough Council to process until the above rates/fees have been agreed. Would this be of help to you?

For information, we met with Jonathan Haine on the 29th and have arranged to meet Glenn Robinson from LCC's Highways Team in a couple of weeks to progress the Section 278 obligations.
