2017/445 – Deletion of Police Records
In response to your recent request for information regarding;
I am requesting information regarding how many requests North Wales Police
have had regarding DELETION OF RECORDS FROM NATIONAL POLICE SYSTEMS
(PNC/NDNAD/IDENT1) during the period January 2015 to May 2017.
How many requests have been successfully resolved i.e. the PNC records have
been deleted?
Since May 2015 all applicants have been referred direct to
ACRO Criminal Records Office
who in affect are a filter system for applications to North Wales Police (NWP). Therefore
when some applications are received by NWP enquiries reveal that the data has already
been deleted or dealt with by ACRO.
ACRO refer some cases back to NWP for Chief Constables decision. Therefore the following
may be of interest:
38 Applications/ enquires received by NWP
5 refused (Pre May 2015) did not come under Exceptional Circs criteria.
8 No Trace Police National Computer (PNC) – Believe these have already been dealt with by
ACPO or data deletion systems
14 applicants directed from NWP Legal to ACRO as per guidelines
11 e mails received from ACRO requesting Chief Constables decision
Of the above:
5 applications authorised for removal by Chief Constable
7 applications refused by Chief Constable
How long does North Wales take in deciding if PNC records are to be processed?
The requests are processed within the Legal Department and forwarded to the Chief
Constable for his decision. Depending on the Chief Constables commitments, he provides
his decision and gives his appropriate authority in writing. This process can take between 1
week and 1 month, following which communication is made by letter with the applicant, who
is informed of the decision.
Is it standard, for the Early Deletion reply that it would take “up to 12 months” for
a decision about deletion to be reached?
No information is held relevant to this question.
The relevant ACPO guidance requires that such intelligence must be “necessary,
adequate, accurate/up to date and not excessive”.
Do North Wales Police update records in line with the above ACPO guidance?
Yes.
