Freedom of Information Act (FOIA) 2000 – Information Request -TWC-44053
Further to your recent request, we are pleased to be able to provide you with the information 
you require, see below.
I would like to make a FOI request for the risk assessments that cover the operation of your 
refuse and recycling operations in the High Ercall area, particularly in the streets in the vicinity 
of the primary school. I am seeking to see where the site specific risks relating to operating 
the refuse/ recycling service during the period when children are being dropped off for school 
are recorded and also that some roads in the area don't have pavements and hence 
pedestrians are in the roadway when your refuse/ recycling lorries are being operated or 
driven past them.
Please refer to the attached risk assessments from both TWS and Veolia regarding 
refuse and recycling collections – 
some information has been redacted as it is 
considered to contain personal information and the following exemption has been 
applied : 

Exemption: -  s40: Personal Data
(1) Any information to which a request for information relates is exempt information if it 
constitutes personal data of which the applicant is not the data subject.
(2) any information to which a request for information relates is also exempt information if:-
(a) it constitutes personal data which do not fall within subsection (1) and
(b) either the 1st or 2nd condition below is satisfied. In the case where the information 
falls within the definition of “data” in section 1(1) of the Data Protection Act (DPA), the 
disclosure otherwise than under the DPA would contravene:-
(1) any of the data protection principles
(2) the right to prevent processing likely to cause damage or distress
If you are not happy with the information you have received, you have the right to appeal.
