Dear A Clerk,
Freedom of Information Requests - RFI20162220 Thank you for your request under the Freedom of Information Act 2000 (the Act) dated 21st
November 2016, seeking the following information:
“In a recent foi response you stated the following...
A: "The TV licence is not a payment or contract for services, rather it is a legal permission to use or
install a television receiver."
B : "The use of a TV receiver without a valid licence is a criminal offence. "
Please provide me with documentation to substantiate the claims A and B above.
(or was it your intention to mislead the public?)
In your response You completely sidestepped my request with your usual bbc bullshit
I read that you are in great financial trouble. I hope you go into liquidation. The sooner the better.”
Under section 14(2) of the Act, we are not required to respond to repeat requests. The
Information Commissioner’s guidance with respect to repeat requests states that where a public
authority has previously complied with a request for information, it is not obliged to comply with a
subsequent identical or substantially similar request from that person.
As we have already dealt with a similar request of yours (RFI20161662), we are of the view that
the BBC is not obliged to comply with this request. If you remain dissatisfied, your appeal rights
are set out below.
Appeal Rights
If you are not satisfied that we have complied with the Act in responding to your request, you
have the right to an internal review by a BBC senior manager or legal adviser. Please contact us at
the address above, explaining what you would like us to review and including your reference
number. If you are not satisfied with the internal review, you can appeal to the Information
Commissioner. The contact details are: Information Commissioner's Office, Wycliffe House,
Water Lane, Wilmslow, Cheshire, SK9 5AF, Tel: 0303 123 1113 (local rate) or 01625 545 745
(national rate) or s
