the statutory timescale of 20 working days, subject to the application of
any exemptions. Where consideration is being given to exemptions the 20
working day timescale may be extended to a period considered reasonable
depending on the nature and circumstances of your request. In such cases
you will be notified and, where possible, a revised time-scale will be

Further to your request received on 28/02/2024, I confirm that the Council
has now considered your request under the Environmental Information
Regulations. Specifically, you have requested the following information:

restricted to correspondence with the following :

Certain names, identities and direct contact details of third
party individuals on these attachments have been redacted, as this would
be disclosing personal data to you; withholding of personal data as
defined by Regulation 12 (3) and 13 of the Environmental Information
Regulations. 

Regulation 12(3) says:
(3) To the extent that the information requested includes personal data
which the applicant is not the data subject shall not be disclosed
otherwise than in accordance with regulation 13

Regulation 13 says:
13 – (1) To the extent that the information requested includes personal
data to which the applicant is not the data subject and as respects which
either the first or second condition is satisfied, a public authority
shall not disclose the personal data.

Furthermore, the first data protection principle states processing of data
should be fair and lawful. As there is no expectation to release junior
council officer’s identities into the public domain unnecessarily and
where these officers are not considered to be key decision makers in
respect of this case, we are satisfied in this case that such information
should be redacted.

It is important to remember that when information is released under the
Freedom of Information Act 2000 & the EIR (2004), it is considered
released to the wider public. The First data protection principle states
processing of data must be fair and lawful and thus in this case we have
decided to withhold personal names. Any such disclosure of personal
information would not be compliant with the provisions of the Data
Protection Act 2018 and the First data protection principle.
