Dear David White
Request FOI/9393
Further to your request received on 28/02/2024, I confirm that the Council
has now considered your request under the Environmental Information
Regulations. Specifically, you have requested the following information:
"Please provide COPIES of ALL information regarding [internal and
external] consultation on the above planning application and ALL comments
provided by consultees [statutory or otherwise], including but not
restricted to correspondence with the following :
+ Spatial Planning
+ Transportation Team
+ Highways Development (as the Highway Authority, with regard to
the safety of all highway users)
+ Tree Team
+ Building Control
+ Ecology Advice Comments Request Team
+ Lead Local Flood Authority
+ Thames Water
+ Ward Councillors
Please note, I am requesting COPIES of each set of comments, NOT a
compilation of the comments received.
Full justification should be provided for the redaction (or
non-disclosure) of any author's name etc."
Please find requested documents attached.
Certain names, identities and direct contact details of third
party individuals on these attachments have been redacted, as this would
be disclosing personal data to you; withholding of personal data as
defined by Regulation 12 (3) and 13 of the Environmental Information
Regulations.
Regulation 12(3) says:
(3) To the extent that the information requested includes personal data
which the applicant is not the data subject shall not be disclosed
otherwise than in accordance with regulation 13
Regulation 13 says:
13 – (1) To the extent that the information requested includes personal
data to which the applicant is not the data subject and as respects which
either the first or second condition is satisfied, a public authority
shall not disclose the personal data.
Furthermore, the first data protection principle states processing of data
should be fair and lawful. As there is no expectation to release junior
council officer’s identities into the public domain unnecessarily and
where these officers are not considered to be key decision makers in
respect of this case, we are satisfied in this case that such information
should be redacted.
It is important to remember that when information is released under the
Freedom of Information Act 2000 & the EIR (2004), it is considered
released to the wider public. The First data protection principle states
processing of data must be fair and lawful and thus in this case we have
decided to withhold personal names. Any such disclosure of personal
information would not be compliant with the provisions of the Data
Protection Act 2018 and the First data protection principle.
The Council publishes Access to Information requests and responses on its
online Disclosure Log. (Any request included within this log will be
anonymised appropriately)
