Dear Ministry of Defence,
At the European Court of Human Rights at Strasbourg, during the
case, (1998), between McGinley and Egan v the United Kingdom,
paragraph 100 of the judgement read: "The Court recalls that the
Government have asserted that there was no pressing National
Security reason for retaining information relating to radiation
levels on Christmas Island following the tests."

I have to advise you that the MOD regards your request as a repeat request under section 14(2) of
the FOI Act. Under the terms of section 14(2) of the Act public authorities are not obliged to comply
with requests for identical or substantially similar information which has previously been requested,
unless a reasonable period has elapsed between the requests. Your request of 23 November 2015
asks for substantially similar information to your earlier FOI requests as follows: 1. I am after the Gamma radiation levels that were recorded during the months of August,
September and October 1958 at 'B' Site, Christmas Island. I have also requested the 'Beta'
radiation levels recorded at ground zero after detonation of both Pennant and Burgee MOD

2. Could you please supply the levels of 'ALPHA' and 'BETA' radiation recorded at Ground Zero
during the first few hours after detonation of Pennant and Burgee MOD reference: 25-06-2012-

3. There were approx 200 men billeted at 'B' site and throughout the months of Aug, Sep, Oct
1958, the radiation levels at the living accommodation was regularly monitored, it was a copy of the

11. Could I please have the readings of the radiation Levels, at Ground Zero, immediately after
detonation, two hours after detonation and 24 hours after detonation for both tests? Both
Operations were held on Christmas Island. Pendant 22 August 1958, Burgee 23 September 1958.
