- Status of the planning applications 19/02898/DISC & 20/02911/CONR and any
updates since 5th Jul 2022 to date:

Note: 19/02898/DISC. Condition 4 (Landscaping) and 5 (Sustainable Drainage System)
planning conditions still to be discharged.

Note: 20/02911/CONR which is a 'full' retrospective planning application is still to be
determined.

- Current status of planning enforcement case file 19/00743/NBI, and any updates since 5 Jul 2022 to date.

Note: I gather that no formal enforcement action has been taken by the LBCC in regards to the enforcement complaint (above). These applications have been pending for quite some time and I have received no substantive response or acknowledgement from LBCC since 5th Jul 2022 to myself directly via email, telephone or letter.

- Any imminent proposals of how to move forward with either an enforcement or determination of the mentioned applications.

Further to your request received on 26/05/2023, I confirm that the Council
has now considered your request under the Environmental Information
Regulations Act 2004. For ease of reference, I will now address each of
your questions in turn.

 

Under the Freedom of Information Act 2000 , can you provide me with the
following information:

 - Status of the planning applications 19/02898/DISC & 20/02911/CONR  and
any updates since 5th Jul 2022 to date:

Note: 19/02898/DISC.   Condition 4 (Landscaping) and 5 (Sustainable
Drainage System) planning conditions still to be discharged.

A decision was taken on this application pursuant to conditions on the
27.02.2020.

The information being requested is exempt from disclosure under Regulation
6(1)(b) of the Regulations on the basis that it is already available and
accessible to you as it is already in the public domain.

Note: 20/02911/CONR which is a 'full' retrospective planning application
is still to be determined.

As set out on the Council’s website this planning application has not yet
been determined and the decision is pending.

 

- Current status of planning enforcement case file 19/00743/NBI, and any
updates since 5 Jul 2022 to date.

The planning enforcement file remains open and there is an ongoing
investigation.

Planning Application 20/02911/CONR remains a live planning application and
has not yet been determined. We also have an open enforcement
investigation in relation to this site.  Planning officers have been
working closely with the Enforcement officers to progress both the
application and the enforcement investigation. We have been seeking to
work through matters with the applicant, however we have been struggling
to make progress as they are not engaging with the process. As a result,
officers have made further site visits to gain further access to the
building so that we have a comprehensive understanding of the development
which has been implemented on site.

We are now in the final stages of gathering all the available information
to enable us to bring application 20/02911/CONR to a decision, we are
reviewing this application alongside officers within the enforcement team
to assess what options are available to us and whether it would be
appropriate to use formal enforcement powers. As with all decisions taken
by the Local Planning Authority when the planning application is
determined the decision alongside an officer report will be available
which will provide details of the work undertaken by the Local Planning
Authority and assessment of the proposal.
