You asked to be provided with two sets of information;- copies of minutes memoranda and correspondence etc held by the Executive from 31st December 2007 on changes to the Health and Safety Enforcing Authority Regulations and copies of information contained on the "HELEX Extranet" that relate to the Health and Safety (Enforcing Authority) Regulations and their implications for local authorities and the HSE.
 
In relation to your first request I can confirm that the Health and Safety Executive holds the following information:-
 
1. a paper to Health and Safety Executive and Local Authority Liaison Committee (HELA) on an evaluation of the HSE/LA Partnership (also attached)  - This concluded that

Flexible Warrants allow HSE and LA inspectors to work across the boundary imposed by the Allocation Regulations. Some areas (e.g. ) have transferred responsibility for various classes of premise from HSE to LA enforcement.  Work to extend these initiatives is being developed in Hampshire and Dorset. NB Not at this stage any proposal to make any decision about consulting on change to the regulatory framework until evidence from trials is available and evaluated.

 

2. Minutes from the HELA meeting although no reference is made to the Allocation Regulations.

 

In relation to your second request I can confirm that the Health and Safety Executive holds the following information:-

 

3.  HELEX provides access to Local Authority Circular 22/13 which clarifies the Health and Safety (Enforcement Authority) Regulations 1998 in relation to motor vehicle repair.

 

4. HELEX provides access to Local Authority Circular 22/15 which defines the current split in enforcement responsibilities under the Health and Safety (Enforcement Authority) Regulations 1998
